- - - -- -- --- - -- <br /> r. <br /> J <br /> The General Contractor is technically in default of the minimum work completion <br /> requirements established by Supplementary General Conditions, Sections 8.25 and <br /> 8.26, of the subject construction contract. Although the Town has yet to declare the <br /> Stone Building Company to be in default of its contractual obligations, we are fast <br /> approaching a date where this action will be unavoidable. At this time, however, the <br /> Town would like to engage in a dialogue with you, as surety, to explore possible ways <br /> of avoiding the significant cost, inconvenience and difficult time restraints which will <br /> inevitably be encountered should the project proceed on its current course. <br /> The Town believes that it has been cooperative and patient with the Stone <br /> Building Company throughout this project. The fact remains, however, that the <br /> Contractor has not done enough to rectify what the Town and its consultants believe is <br /> an undermanned and uncoordinated work force on the project. The Contractor has <br /> furthermore failed to perform critical elements of the project work in a satisfactory <br /> manner. <br /> The Town would like to explore every possibility short of litigation to resolve <br /> these outstanding project issues. We believe that, at this time, it would be fruitful to <br /> engage in discussions with Liberty Mutual and the General Contractor in one final <br /> effort to resolve the persistent scheduling and work completion problems encountered <br /> on the subject project over the past six months. In the event that a viable project <br /> schedule and work plan cannot be negotiated by the parties within the next few weeks, <br /> the Town believes it will have no alternative but to declare the General Contractor to be <br /> in default of its contractual obligations and to proceed with appropriate legal action. <br /> I would appreciate your investigation of this matter and a reply to this letter at <br /> your earliest possible convenience.
