Practical Considerations to Facilitate Beneficial Occupancy From a practical standpoint, our opinion is that, provided sustained pressure is brought to bear on Stone, occupation of the class rooms is possible sometime in August or the first two weeks of September 1996. As we have not received a substantial completion plan from Stone (which was due on 5th June 1996), we are not presently in a position to provide a more accurate date. We would stress that this assessment is conditional upon Stone exerting its utmost efforts for the next eleven weeks, action which will most probably entail the widespread use of overtime and weekend work. We would also point out that the school administration should expect severe congestion in the weeks immediately prior to school opening due to the competing demands of punch list work and furniture and equipment delivery. Without the rapid development and implementation of a comprehensive completion plan, we would be concerned that, even with an extended working week, the school may not be available when it is required. For example, the Sewage Treatment Plant, which should have been operational by 1st May 1996, requires an input from a number of agencies before a Clear Water Certificate will be issued. Ideas are abroad to provide a temporary solution but a plan for all to ,see has yet to be provided by Stone. Likewise, agreement on what siteworks will be complete is equally pressing. Inside the Academic Block the class rooms are at a relatively advanced state of completion, Derricks 1 and 4 in particular. Page 3 of this opinion contains a summary list of the activities necessary to the achievement of beneficial occupancy of the class rooms and science laboratories. The Architect has a more developed list and we are aware that a preliminary punch list has been prepared by LibertyBond Services. We are less confident that the administrative area, including the library, will be available in the timescale which we have indicated. Derrick 6 is not yet weather tight, bacterial growth is evident at a number of locations, pipework in the library ceiling area has not been corrected and drywall in E103/E104/E105 has yet to be completed. We envisage a scenario where the classrooms could be occupied but that work would still be ongoing in Derrick 6. In essence, trailers might be necessary to house the administrative staff provided blocking off the administration area is acceptable to the Architect and the Building Inspector.
