At no time should any cull materials be placed above the high water mark on public or private <br /> property. <br /> 11) All holes made by dry-digging shellfish shall be filled in and seed replanted before moving to another area. t <br /> 12) The harvesting of shellfish by any means or methods other than those approved by the Board of Selectmen <br /> is prohibited. Shellfish may be taken by hand, short-handled clam rake, hand trowel, (garden variety) <br /> ' spade fork, plunger, dip net, scratcher or "potato rake", basket rake or bull rake, or scallop drags (see the i <br /> l scallop regulations for drag restrictions). Mechanical or hydraulic harvesting tools or methods, or use of a <br /> approved harvesting tools from a vessel under power or sail is prohibited unless allowed under a special 1 <br /> permit or regulation issued by the Board of Selectmen. <br /> 13) The harvesting of eels, oysters, and scallops are subject to separate and/or additional regulations as set forth <br /> in Article 5 of these regulations. <br /> E14) Digging or plunging shellfish within two feet of the edge of a marsh structure is prohibited. Digging or <br /> displacing marsh grass is prohibited. <br /> 15) Scuba diving for the purpose of taking shellfish is prohibited. Snorkeling or skin diving for shellfish is <br /> allowed in all approved swimming areas of the Town of Mashpee. (Skin divers are subject to Mashpee <br />'I Bylaws, Article 4.7, Section 4.7.5.1). <br /> ji 16) All shellfish predators such as starfish,whelks and their eggcases, and cockles should be removed from the t <br /> water and deposited above the high water mark in an appropriate receptacle such as a public trash barrel at a <br /> town landing, or removed and deposited at the town dump. <br />{; 17) All shellfish shall be brought ashore in the shell. <br /> i, ARTICLE IV. COMMERCIAL SHELLFISH REGULATIONS <br /> Commercial shellfish permit holders are subject to all regulations set forth in Article III as well as the following: <br /> 1) Commercial shellfishing is prohibited on Sundays. <br /> 2) No commercial permit holder shall harvest shellfish from areas designated as "Family Permit Only" except <br /> for species allowed under such designation as where stipulated otherwise in any other section of these <br /> regulations. (See scallop, oysters regs.) <br /> 3) A commercial permit holder may also hold a Mashpee Non-Commercial Family Shellfishing Permit <br /> However he/she may only fish that permit on Sundays. Other members of a commercial shellfisherman's <br /> 9 family are not subject to this restriction. <br /> g 4) No commercial shellfish permit holder shall employ or otherwise be assisted by an <br /> individual in the act <br /> E of taking, harvesting or culling shellfish unless that person is also a licensed Mashpee Commercial <br /> Shellfisherman,unless stated otherwise in these regulations. <br /> ARTICLE V SPECIAL PERMITS, SEASONS, REGULATIONS <br /> 1) Eel Regulations - the waters of the Town of Mashpee are closed to the taking of eels by any means other <br /> than a single hook and line or by spearing. The use of eel pots or multi-hook rigs is prohibited until further <br /> notice. <br /> 2) Oyster Regulations-the harvesting of oysters is prohibited until further notice. <br /> 3) Scallop Regulations- to be submitted at a later date. <br /> 4) Shellfish Grant Regulations-to be submitted at a later date. <br />
