Moderator read Article 31 i <br /> I <br /> Article 31. To see if the Town will vote to amend the Town <br /> By-Laws by deleting Section 4 . 5.3. 2 (f) and substituting therefore <br /> the following: <br /> "Drinks or consumes any alcoholic beverages or possesses any <br /> . opened container thereof in the immediate place wherehe is located " <br /> in any vehicle upon a public highway, or while upon a .public highway, ,,: <br /> sidewalk, or while on any public area or in any public places not <br /> duly licensed for such purposes within the Town of Mashpee during <br /> the lawful hours of operation of such licensed premises. " Submitted <br /> by the Board of Selectmen. <br /> Kr Garland: <br /> I move that article 31 be approved as printed in the warrant. <br /> Motion seconded <br /> Moderator: I think the Police Chief can give us a handle on it, it gives <br /> him a better handle on z-rhat he can do. Is that right Chief? <br /> Chief Frye: This is a atate Law. If we put it into the Town By-Laws we will <br /> be getting most of the fines from the courts. <br /> All those in favor - say aye; opposed no Motion carried. I defer to joseuh teardon; Town Counsel. <br /> Mr Reardon: I relieve the explanation is fairly clear. <br /> In the first sentence it suggests <br /> that the Selectmen shall assess betterments upon the owners of estates <br /> which derive particular benefit or advantage from the repairs. The <br /> second sentence, however, restricts the assessment to tae owners of the <br /> estates fronting on the road where the repairs are to be made. 1 <br /> There could be a substantial conflict if the Selectmen make a determinatio ? <br /> on a betterment being proposed ignoring "those whose whose property does <br /> not have frontage on the road. This is really a curative piece of legis- f <br /> lation. <br /> Moderator: 'What he is really saying -- He is a good friend or mine-- <br /> I love'Attorneys. If betterments are done and you happen to be on that fay ; <br /> you are going to be assessed; but so is everybody else-who 1ivsq,7;down that : <br /> road and derives the t- e benefits, so its going to cost less <br /> I-Ir Reardon: Only if the Selectmen make that decision.
