ARTICLE 12: To see if the Town will vote to amend the <br /> Zoning By—Laws as follows : <br /> To Sec %ion 4 add the following new Subsection : <br /> 4. I0 In order to provide for the -protect-ion o <br /> public rights and interests in roads, ways <br /> and historic accesses to water , this sub— <br /> section is established to regulate the use, <br /> relocatii.an , alteration or discontinuance of <br /> such roads, ways and accesses . The term <br /> "way" as used in this sub@ection means any <br /> way which has become , by Town action , by its <br /> status as a legal " ancient way" or by pr�-- <br /> scriptive use , a public way, but shall not <br /> include any way under the control of the <br /> Commonwealth of Massachusetts or the United <br /> States of America. Where a way has been <br /> surveyed and laid out , the provisions of <br /> this subsection shall be applicable to all <br /> lands within said layout . Otherwise , they <br /> shall be applicable to the actual area of <br /> land occupied by such ways. <br /> 4 . 10 . 1 No building, road or other structure may be <br /> located on , or in such a manner as to inter— <br /> fere with public access to, or use of , such <br /> a way. <br /> 4. 10 . 2 No fence , pole , trash , fill , curb or other <br /> similar object may be located in such a manner <br /> as to interfere with public access to, or use <br /> of , such a way. <br /> 4 . 10 . 3 No subdivision or other division of land shall <br /> be created, nor any private road be laid out , <br /> in such a manner as to interfere with public <br /> access to, or use of , such a way or to <br /> enc=ourage the siting of buildings, wells, <br /> wastewater facilities, utilities or other <br /> improvements in such a manner as to inter— <br /> fere with public access to, or use of , such <br /> a way . <br /> 4 . 10 . 4 No building permit , special permit , subdi — <br /> vision approval or other permit or approval <br /> may be granted by any Town board or agent <br /> regarding a lot or parcel of land where <br /> the provisions of this subsection have not <br /> been met . <br /> 4. 10 . 5 No such way may be relocated or altered, <br /> except by the Board of Selectmen as pro— <br /> vided by M.G.L. Chapter 82, Section 21 or <br />
