4. 10 .7 Where there is any doubt regarding the public ' - - <br /> status of any way, the Board of Selectmen <br /> shall render an opinion .upon the request of <br /> any party. In the case of ways appearing on <br /> + a map entitled "Public and Historic Ways in <br /> - the Town .of_. Mashpe.e ,-_January ,. 1 496.°. on f l e <br /> in the office of the Town Clerk , there shall <br /> be a presumption that the way is a public <br /> way unless conclusive legal proof can be <br /> given to the Board .of Selectmen to the con- <br /> trary. -`For •ways-not -shown, on said map , <br /> suffictient -prmof �shalI be required before <br /> the Board may�etermisae tkat a way is a public <br /> way, said proof -ta-,be in the form of evidence <br /> of Town action, ; open rand uninterupted use by <br /> the public for a � � <br /> ersd in excess of twenty <br /> rears, or _other legal evidence .
