From :he 3tadilization 'Und to tn9 <br /> f ]Chaal '�clli Cl? aCCaunt. . . . mC flan C�rLi2S. . unani Tcus. . . . . . . . . . .0 : 13 .`% . <br /> o cn :c 'c 'aurn. . motion carr' =s. . . . <br /> u <br /> ?1. <br /> order un '-3Y Ih'_�.'� 3L <br /> Article 35 <br /> To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or <br /> eminent domain for roadway and trail purposes that portion of the land shown on the 1989 <br /> Mashpee Assessors' Maps as Map 28, Plot 68 which is bounded on the,south by Route <br /> 130, on the west by South Sandwich Road and extending easterly 100 feet along the <br /> northern property line of Plot 68, and on the east by a line running due south from the <br /> eastern end of the above-mentioned 100 foot line to a cranberry bog, by the northern, <br /> western and southern edge of said bog and by the west side of a ditch running south from <br /> said bog to the northern sideline of Route 130, all as approximately shown on a plan <br /> ` entitled "South Sandwich Intersection Acquisition" dated March, 1989,which is on file in <br /> the office of the Town Clerk, and to acquire by purchase or eminent domain for <br /> conservation purposes that land shown on the 1989 Assessors' Maps as Map 36, Plot 38, <br /> containing approximately 2.2 acres to be held in the care and custody of the Conservation <br /> Commission pursuant to Massachusetts General Laws Chapter 40, Section 8C; and further, <br /> to see if the Town will vote to appropriate a sum of money for such purpose, including <br /> expenses incidental and related thereto, and to raise such appropriation, the Treasurer, with <br /> the approval of the Selectmen,be authorized to borrow a sum of money under and pursuant <br /> to Chapter 44, Sections 7 and 8 and, if applicable, Chapter 40, Section 8C, of the General <br /> Laws, or any other enabling authority, and to issue bonds or notes of the Town therefore, <br /> with said bonding authorization contingent upon passage of a referendum to exclude the <br /> principal and interest on such debt from the tax levy limitation imposed by Chapter 59, <br /> Section 2 1 C of the General Laws (so-called Proposition 2 1/2); and further, to see if the <br /> Town will vote to raise and appropriate or transfer from available funds a sum of money to <br /> the Purchase of Map 280ot 68 Account to provide for interest and debt issuance expenses; <br /> further, to see if the Town will authorize the Board of Selectmen and/or Conservation <br /> Commission to apply for and accept Federal and/or State grants, including reimbursement <br /> under Chapter 132A, Section 11 of the General Laws, or accept private gifts,to be applied <br /> by the Town toward the financing of this purchase, and to enter into contracts and <br /> agreements with Federal and/or State agencies, private conservation trusts, or other entities <br /> or persons in connection with the purchase of such land and preservation for conservation <br /> purposes of the specified portion of such land; and finally, to see if the Town will authorize <br /> the Conservation Commission and the Board of Selectmen to enter into agreements and <br /> execute any and all instruments as may be necessary on behalf of the Town to effectuate <br /> said purchase; or take any other action related thereto. <br /> Olcticn accept as amended. . . . see Following. . . . . . . . . . <br />
