From :he 3tadilization 'Und to tn9 f ]Chaal '�clli Cl? aCCaunt. . . . mC flan C�rLi2S. . unani Tcus. . . . . . . . . . .0 : 13 .`% . o cn :c 'c 'aurn. . motion carr' =s. . . . u ?1. order un '-3Y Ih'_�.'� 3L Article 35 To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or eminent domain for roadway and trail purposes that portion of the land shown on the 1989 Mashpee Assessors' Maps as Map 28, Plot 68 which is bounded on the,south by Route 130, on the west by South Sandwich Road and extending easterly 100 feet along the northern property line of Plot 68, and on the east by a line running due south from the eastern end of the above-mentioned 100 foot line to a cranberry bog, by the northern, western and southern edge of said bog and by the west side of a ditch running south from said bog to the northern sideline of Route 130, all as approximately shown on a plan ` entitled "South Sandwich Intersection Acquisition" dated March, 1989,which is on file in the office of the Town Clerk, and to acquire by purchase or eminent domain for conservation purposes that land shown on the 1989 Assessors' Maps as Map 36, Plot 38, containing approximately 2.2 acres to be held in the care and custody of the Conservation Commission pursuant to Massachusetts General Laws Chapter 40, Section 8C; and further, to see if the Town will vote to appropriate a sum of money for such purpose, including expenses incidental and related thereto, and to raise such appropriation, the Treasurer, with the approval of the Selectmen,be authorized to borrow a sum of money under and pursuant to Chapter 44, Sections 7 and 8 and, if applicable, Chapter 40, Section 8C, of the General Laws, or any other enabling authority, and to issue bonds or notes of the Town therefore, with said bonding authorization contingent upon passage of a referendum to exclude the principal and interest on such debt from the tax levy limitation imposed by Chapter 59, Section 2 1 C of the General Laws (so-called Proposition 2 1/2); and further, to see if the Town will vote to raise and appropriate or transfer from available funds a sum of money to the Purchase of Map 280ot 68 Account to provide for interest and debt issuance expenses; further, to see if the Town will authorize the Board of Selectmen and/or Conservation Commission to apply for and accept Federal and/or State grants, including reimbursement under Chapter 132A, Section 11 of the General Laws, or accept private gifts,to be applied by the Town toward the financing of this purchase, and to enter into contracts and agreements with Federal and/or State agencies, private conservation trusts, or other entities or persons in connection with the purchase of such land and preservation for conservation purposes of the specified portion of such land; and finally, to see if the Town will authorize the Conservation Commission and the Board of Selectmen to enter into agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate said purchase; or take any other action related thereto.
