Article 4 <br /> To see if the Town will vote to amend the Zoning By-Law as follows: <br /> In Subsection 174-3A, add the following new definition: <br /> • "COMMERCIAL CENTER - A group of commercial, office and similar <br /> establishments involving one, or more than one, principal structure, <br /> with said structure or structures containing more than 10,000 square <br /> feet of gross floor area, located on a site which has been planned, <br /> developed and managed as an operating unit and including parking, <br /> highway access, signage and other facilities shared by said <br /> - establishments." <br /> In Subsection 174-3A, replace the definition of "SPECIAL PERMIT GRANTING <br /> AUTHORITY" with the following: <br /> "SPECIAL PERMIT GRANTING AUTHORITY - The Planning Board or <br /> J <br /> Board of Appeals as designated in Article VI or any other applicable <br /> sections of this chapter." <br /> In Subsection 174-24A.(4), first sentence, replace the words "Board of Appeals" with <br /> the phrase "Planning Board or Board of Appeals, as applicable, pursuant to the <br /> provisions of Subsection C" and replace the phrase "gross first-floor area" with the <br /> phrase "gross floor area." <br /> J <br /> Replace the existing Subsection 174-24C(1) with the following: <br /> "(1) Uses and developments allowed under the provisions of Article <br /> IX shall be permitted as a special exception only if the Planning <br /> Board so determines and grants a special permit therefor. Any <br /> other uses denoted in Section 174-25 by the letters "SP," or by the <br /> letters "PR/SP" where construction of a building or addition <br /> containing more than one thousand (1000) square feet of gross <br /> floor area is involved, shall be permitted as a special exception <br /> only if the Planning Board so determines and grants a special <br /> permit therefor, except that for non-residential uses not involving <br /> new structures containing more than ten thousand (10,000) square <br /> feet of gross floor area and not involving a site greater than five <br /> ` (5) acres in area, or expansions which do not result in a total of <br /> r more than ten thousand (10,000) square feet of gross floor area on <br /> a site, or residential conversions under Subsection 174-25A(8) or <br /> for other uses specified by the General Laws for review by the <br /> Board of Appeals, such use shall be permitted as a special <br /> exception only if,the Board of Appeals so determines and grants a <br /> special permit therefor." <br /> J <br /> J <br />
