A. All Personal Watercraft operation is subject to the applicable provisions of the General <br /> Laws of the Commonwealth, as amended, and to further restriction that no motor or <br /> propelled surfboard or other personal watercraft operation is allowed in Mashpee in or on <br /> r the freshwater ponds before the hour of 10:00 a.m. and after the hour of 7:00 p.m. <br /> B. Personal Watercraft operation is permitted on fresh water ponds and tidal waters of <br /> Popponesset Bay,Nantucket Sound, and Waquoit Bay subject to the same restrictions for <br /> watercraft above. In addition,prohibited activities are: <br /> 1. Towing any object using a personal watercraft. <br /> 2. Operation between the hours of sunrise and sunset or when vision is unduly <br /> restricted by weather <br /> 3. Operation on bodies of water of less than seventy-five(75 acres) <br /> 4. Operation by a person under the age of sixteen(16) <br /> 5. Operation by a person between sixteen (16) and seventeen (17) without first <br /> having received a safety certificate required by 323 CMR 4.03(2) <br /> C. All Personal Watercraft operators shall wear a wearable Personal Flotation Device (Type <br /> III or better; Life belts are not acceptable.) <br /> §170-7. Swim Area. [Added 19951 <br /> A. Public Bathing Area r <br /> No Person shall operate a watercraft: <br /> 1. within one hundred fifty(150) feet of a public bathing area <br /> 2. within one hundred fifty (150) to three hundred (300) feet of a shoreline which is <br /> being used as a private swim area. <br /> §170-8. Divers and Diving [Added 5-3-82 ATM,Art.28,approved 9-7-821. <br /> Any person or persons skin diving or scuba diving shall: <br /> A. Display a diver's flag constructed of rigidly supported material at least twelve by fifteen <br /> (12x15) inches in an area or red background with a white diagonal stripe. <br /> B. Display such flag on a boat or surface float extending a minimum distance of three (3) <br /> feet from the surface of the water, or to such other height in excess of three (3) feet as to <br /> be sufficient to be visible to passing boats. <br /> C. Stay in an area within one hundred (100) feet of such displayed diver's flag while at or <br /> near the surface of the water. <br /> D.
