i <br /> i <br /> Submitted by Planning Board <br /> Explanation: Due to a recent ruling by the state's Department of <br /> Telecommunications & Energy, providers of "Commercial Mobile Radio <br /> Services", which include cellular phone, paging and a number of other <br /> communications services involving radio towers, are now considered "public <br /> service corporations", aka public utilities. In order to avoid allowing such towers, <br /> and other large public utility facilities such as power lines, power plants, etc. with <br /> no public hearing (the "PR" plan review process involves only 14 day Town staff <br /> review after a permit filing with the Building Inspector), this amendment would <br /> make them subject to special permit review, as was the case before the "Plan <br /> Review"process was created in the mid `80s. <br /> Motion made by Nancy Caffyn. <br /> Motion: I move Article 34 be approved as printed in the warrant with the <br /> exception of the phrase, "or take any other action related thereto." <br /> Planning Board voted at the Public Hearing held on August 19, 1998 4 to 0 <br /> for approval. <br /> Motion passes unanimously at 9:12pm. <br /> Article 35 <br /> To see if the Town will vote to amend the zoning bylaw by adding the following <br /> new sections and subsections: <br /> Add the following to the listing of zoning districts contained in Section 174-4: <br /> "Wireless Facility Overlay District". <br /> Add the following new Subsection C. to Section 174-5 Establishment of Zoning <br /> Map: <br /> "C. The Wireless Facility Overlay District shall include 1) the area within the <br /> 210 foot wide Commonwealth Electric Company transmission line <br /> easement running generally east-west between the Falmouth town line and <br /> the Barnstable town line, 2) all other lands in the Town which are not <br /> located within the boundaries of the Mashpee National Wildlife Refuge, <br /> within 1000 feet of the mean high water line of a Great Pond or a tidal water <br /> body, within Historic Districts, within 1000 feet of a Historic District or of <br /> structures or places listed in the 1997 Massachusetts State Register of <br /> Historic Places, within the Otis A.N.G.B. Accident Prevention Zone or <br /> within 300 feet of the right of way of any designated scenic roadway." <br /> Add the following new Subsection H.(8) to Section 174-25.
