(3) Applications for building permits for new dwelling units may be filed only during the first fifteen(15) <br /> days of any month. However, no such permits will be approved until after the 15th day of the month j <br /> to allow proper review and determination of the order of priority in which they may be issued. <br /> Permits which are exempted by Subsection C or temporarily protected by Massachusetts General Laws <br /> from the provisions of this section or permits for those persons described in Subsection D(4)(a) below <br /> may be applied for or issued at any time. [Amended 5-3-1993 ATi<I,Art.9, approved 7-19-19931 <br /> (4) In issuing building permits, the Building Inspector shall first determine that the application and <br /> proposed structure conforms to the rules and regulations of the Board of Health, with any applicable <br /> building codes and with this Zoning Bylaw, including the provisions of this section. For those <br /> applications which are in conformance and may otherwise be issued, building permits shall be issued, <br /> within the monthly limit, in the following order of priority: <br /> (a) First. Provided that the annual limit has not been exceeded, in the order of their receipt by the <br /> Building Inspector, applications for individual single-family dwellings by the legal owner of any { <br /> lot on January 1 of the previous year who has not received a permit for a new residence in <br /> Mashpee during the previous twenty-four(24)months and who has documented, in writing to the <br /> I <br /> Building Inspector his intention to be the exclusive resident on the premises for at least one (1) <br /> year["residence" being defined as occupation by the members of one (1) family for at least thirty <br /> (30)days in said year with no occupation or rental by other persons during that period.] <br /> (b) Second. Provided that monthly and annual limits have not been exceeded, in the order of their I <br /> receipt by the Building Inspector, one(1)application in any month for a single-family dwelling by <br /> a licensed construction supervisor who has received no more than five (5) building permits for <br /> new residences in Mashpee in the previous twelve-month period, except that, among such <br /> applications, structures not located within a Primary or Secondary Conservation Area shown on <br /> the most recently adopted first, then any others may be approved. <br /> (c) Third. Provided that the monthly and annual limits have not been exceeded, permits for any <br /> dwelling units for which permits were applied for in previous months but were not approved <br /> based on the provisions of this section may be approved, in the order of their receipt by the <br /> Building Inspector, up to the monthly and annual limits, except that among such applications, <br /> structures not located within a Primary or Secondary Conservation Area shown on the most <br /> recently adopted open space incentive plan shall be approved first, then any others may be <br /> L. <br /> approved. <br /> (d) Fourth. If after permits have been issued to all applicants in the first through third categories and <br /> the monthly and annual limits have not been reached, building permits may be issued to other �.. <br /> applicants up the limits, in the order of their receipt by the Building Inspector, except that <br /> structures not located within a Primary or Secondary Conservation Area shown on the most <br /> recently adopted open space incentive plan shall be approved first, then any others may be <br /> approved. <br /> (5) An application shall be considered received by the Building Inspector only if it is complete it all <br /> aspects, conforms to all applicable building codes and this Zoning Bylaw and has received all <br /> necessary approvals from the Board of Health and, where necessary, the Board of Appeals and/or �- <br /> Conservation Commission. Upon receipt of any application, it shall be marked with the date and time <br /> of receipt. <br /> i <br /> (6) If in any month building permits for fewer dwelling units are issued than are allowed by the limits of <br /> Subsection B (2), the difference between the limit and the actual number of dwelling units for which <br /> were issued <br /> may be added to the limit for the following month, except at the end of the <br /> permits y <br /> P i" <br /> calendar year. <br /> 28 <br />
