(7) Where a building permit is to expire, no more than one(1)six-month extension may be granted by the <br /> Building Inspector before an applicant shall be required to file for a new permit following the rules <br /> and procedures of this Article and other applicable laws and regulations. <br /> §174-27. Water quality report. <br /> A. As a part of any application for approval of a definitive subdivision plan [excluding plans which would <br /> divide any parcel shown on the 1985 tvlashpee Assessors' Maps into five (5) or fewer lots or where <br /> proposed density of residential development would be less than one (1) unit per two (2) acres] or of a <br /> special permit requiring approval by the Planning Board, the applicant shall submit ten (10) copies of a <br /> water quality report regarding the proposed development. Said report shall be completed by a qualified <br /> firm, experienced in groundwater and surface water quality evaluation and in determining the impacts of <br /> land uses on receiving waters. One(1) copy of the report shall be transmitted for review and comment to <br /> the Board of Health. <br /> B. The water quality report shall contain,at a minimum,the following information: <br /> (1) Whether or not the development lies within a Groundwater Protection District(see Art. XIII),within a <br /> previously defined Zone II recharge area of an existing or proposed public water supply well, within <br /> three hundred (300) feet of the Santuit, Mashpee, Quashnet or Childs Rivers, Quaker Run south of <br /> Route 28, Red Brook or any pond, bay or other surface water body or any adjacent wetlands as <br /> defined by MGL C. 131, §40, or within the groundwater recharge zone of any great pond or bay or <br /> other surface water body over one(1) acre. (With regard to the groundwater recharge zones of Santuit <br /> Pond, Mashpee-Wakeby Pond, Johns Pond and Moody Pond, Jehu Pond, Ockway Bay and Hamblin <br /> Pond/Red Brook, reference shall be made to maps produced by K-V Associates of Falmouth, <br /> Massachusetts,which are on file in the office of the Town Planner. For other great ponds or bays and <br /> surface water bodies over one (1) acre, a map of the groundwater recharge zone shall be produced as <br /> part of the water quality report if it appears that the development may lie within the recharge zone of <br /> said water body.)[Amended 5-7-1990 STM,Art.8,approved 11-19-19901 j <br /> (2) Whether or not the development will produce any hazardous or toxic materials [as defined in 314 <br /> CMR Section 3.02(21), (22) and (48) or if such materials will be stored (upon completion of the <br /> development) on the site. If so, the report shall specify how such materials will have any impact on <br /> public health or safety. <br /> I <br /> (3) Whether or not the development will cause any runoff of roadway drainage or runoff of sediment due <br /> to erosion into any surface water body, watercourse or wetland and if it will adversely affect any <br /> fishery,shellfish bed or other wildlife or aquatic vegetative resources. <br /> (4) A determination of the levels, in total pounds and in pounds per acre, of nitrogen and phosphorus <br /> which could be generated by the development. In making such determination,the following standards <br /> shall be used unless the applicant demonstrates to the satisfaction of the Board that other standards are <br /> applicable: <br /> i <br /> (a) Loading per person: five (5) pounds nitrogen per person per year; twenty-five-hundredths (0.25) <br /> pounds phosphorus per person per year. Persons per dwelling unit equals three(3). <br /> (b) For commercial and industrial developments, nitrogen and phosphorus calculations shall be <br /> derived from expected wastewater generation as specified by Title V of MGL C. 21 A, §13. <br /> (c) Loading from lawn fertilizer: three (3) pounds nitrogen per one thousand (1,000) square feet per <br /> year [with a minimum of fifteen (15) pounds per lot in a single-family subdivision]; seventeen- <br /> hundredths (0.17) pound phosphorous per one thousand (1,000) square feet per year [with a <br /> minimum of eighty-five hundredths(0.85)pound per lot in a single-family subdivision). <br /> TRUE COPY, 29 <br /> CLERK 0F h1,, '-HP-77,7k,111�A --- <br />
