Article 32 <br /> To see if the Town will amend the zoning by-law by amending footnote 14 of the Section <br /> 174-31 Land Space Requirements Table to read as follows: <br /> " 14 Minimum front building setback from Routes 28 and 151, from Great Neck Road South and North <br /> and from Route 130 west of Great Neck Road (except within the Mashpee Center Overlay District) <br /> shall be seventy-five (75) feet and, except for permitted signs and one (1) access driveway involving <br /> clearance of a path no more than forty (40) feet in width, the first fifty (50) feet of the front setback <br /> area shall be left wooded and in its natural state, except that said area may be reduced by the Special <br /> Permit Granting Authority as part of its decision on a special permit approved under Sections 174-45.1 <br /> or 174-46. Where such area is not naturally wooded, it shall be suitably planted with sufficient trees <br /> and understory vegetation, of a type common in natural areas of Mashpee, to replicate a naturally <br /> wooded area and to constitute a visual barrier between the proposed development and the roadway. <br /> Under no circumstances will parking, retention ponds, or any other development involving clearance <br /> of natural vegetation be permitted within said area.Limited,appropriate tree surgery or similar limited <br /> maintenance required to protect the health of vegetation in this area may be allowed with the approval <br /> of the special permit authority which originally authorized the project which included said area or, if <br /> no special permit was required,with the approval of a majority of the Planning Board." <br /> and by adding a reference to footnote 14 in the C-2 row of the front setback column of <br /> said Table, <br /> or take any other action relating thereto. <br /> ° Submitted by the Board of Selectmen <br /> Explanation: This article would prevent removal of existing natural vegetation in 50 foot buffer areas <br /> along Routes 28 and 151 and Great Neck Road South and North within commercial zoning districts. The <br /> bylaw currently allows"landscaping"within this buffer area,which has resulted, in some cases,in <br /> clearcutting of the natural vegetation and replacement with minimal landscaping inconsistent with the <br /> woodland character of Mashpee's landscape.
