i <br /> a <br /> Article 42 <br /> We the undersigned hereby petition the Town of Mashpee to see-if the Town will vote to <br /> accept the road conversion estimate for Trout Brook Road, Yellow Perch Circle, Bass <br /> Cove Circle and Alewife Road, "Compiled Road Easement Taking Plans for Pickerel <br /> Cove Subdivision in Mashpee, Massachusetts", dated September 2, 1999, Which layout <br /> has been filed in the Office of the Town Clerk, not later than seven days prior to the date <br /> of the vote hereunder and to authorize the Board of Selectmen to acquire by gift, <br /> purchase or eminent domain taking any land necessary for the purposes of such ways as <br /> so laid out, and to raise and appropriate, transfer from available funds or borrow a sum or <br /> sums for such purchase or taking including borrowing costs therefor, and to further <br /> authorize the Board of Selectmen to assess betterment's to the owners of the land <br /> abutting the ways, or take any other action relating thereto. <br /> Submitted by Petition <br /> Motion made by Peter Thomas. <br /> Motion: I move the Town hereby accept the layout of Trout Brook Road, Yellow Perch <br /> Circle, Bass Cove Circle and Alewife Road as public ways as shown on a plan entitled, <br /> "Compiled Road Easement Taking Plans for Pickerel Cove Subdivision in Mashpee, <br /> Massachusetts", dated September 2, 1999, which layout has been filed in the office of the <br /> Town Clerk not later than seven days prior to the vote hereunder; that the Selectmen are <br /> authorized to acquire by gift, purchase or eminent domain taking any land necessary for <br /> the purpose of such ways so laid out; that the sum of$93,840 be hereby appropriated and <br /> authorized to be borrowed under and pursuant to Chapter 44, Section 7 of the General <br /> Laws, or any other enabling authority, for such purchase or taking and layout, including <br /> costs of constructing such ways and legal, financing and other costs incidental and related <br /> thereto; and that the Board of Selectmen is authorized to access betterments to the owners <br /> of land abutting the way. <br /> Motion passes unanimously at 8:03 p.m. <br /> of tepee, <br /> own I. <br /> i <br />
