<br /> disrupt any species listed as rare, endangered or threatened by the Massachusetts Natural
<br /> Heritage Program or any known historic or archaeologic site, will not produce amounts of
<br /> trash, refuse or debris in excess of the town's landfill and waste disposal capacities, will
<br /> properly dispose of stumps, construction debris, hazardous materials and other waste, will
<br /> provide adequate off-street parking,will not cause excessive erosion or cause increased runoff
<br /> onto neighboring properties or into any natural river,stream,pond or water body and will not
<br /> otherwise be detrimental to the town or the area.
<br /> (3) In all cases involving a special permit, the application shall include a site plan showing at
<br /> least the location of buildings on the site(meaning the entire lot on which the proposed use or
<br /> development is located) and within one hundred (100) feet of the site, existing and proposed
<br /> wells and septic systems, existing roadways, wetlands,water-courses and significant slope or
<br /> other natural features,proposed parking,drainage utilities and landscaping and other proposed
<br /> features. For applications to the Planning Board,a plan showing topography at a maximum of
<br /> two-foot contour interval shall also be required. In addition, traffic studies, water-quality
<br /> impact reports, environmental impact reports, fiscal impact reports and similar items may be
<br /> required along with those other specific items required by§§174-46 and 47.
<br /> (4) For applications to the Board of Appeals, at last three (3) copies of all application materials I
<br /> shall be submitted, of which one (1) shall be transmitted to the Design Review Committee.
<br /> Where the application involves any land within one hundred (100) feet of a wetland, water
<br /> body or watercourse, a fourth copy shall be submitted for review by the Conservation
<br /> Commission. Where the application involves tidal areas or waterways, copies shall also be
<br /> submitted for review by the Shellfish Commission,Harbormaster and Waterways Committee.
<br /> The Board of Appeals shall consider ancomments of the
<br /> Y Design Review Committee ,
<br /> Conservation Commission, Shellfish Commission,Harbormaster and other town officials and
<br /> boards in making its decision, provided that such comments are received at or before the
<br /> required public hearing.
<br /> (5) For applications to the Planning Board, at least seventeen (17) copies of all application
<br /> materials shall be submitted, unless additional copies are required elsewhere in this chapter.
<br /> Where additional copies are not otherwise required by Article IX to be submitted by an
<br /> applicant to town officials, the Board shall transmit copies to the Board of Health, Mashpee
<br /> Water District Commission, Sewer Commission, Design Review Committee, Conservation
<br /> Commission, Town Planner, Superintendent of Streets,Building Inspector, Fire Chief,Police
<br /> Chief and Parks and Recreation Director and, where the application involves tidal areas or
<br /> waterways, shall also submit copies to the Shellfish Commissioner, Harbormaster and
<br /> Waterways Committee,and the applicant shall supply such additional copies. In addition,for
<br /> mixed-use or commercial developments or projects which will involve a variance request, a
<br /> copy shall be provided for review by the Board of Appeals. The Planning Board shall
<br /> consider any comments received from the above-named officials and beards in making its
<br /> decision,provided that such comments are received at or prior to the required public hearing.

<br /> (6) Special permits shall only be issued following a public hearing held within sixty-five (65)
<br /> days,but not less than twenty-one(21)days,after the filing of an application which conforms
<br /> in form and content to the requirements of this section, including all required plans, i
<br /> supporting documents and abutters' lists and any other application requirements established
<br /> by the special permit granting authority,with the Town Clerk. The required number of copies
<br /> of such application, including the date and time of filing certified by the Town Clerk and
<br /> including the required plans, documents and abutters' lists noted above, shall be then filed j
<br /> forthwith by the.petitioner with the special permit granting authority. [Amended 5-8-1989

<br /> (7) An application for a special permit may be approved, approved with conditions or denied.
