Article 28 <br /> To see if the Town will vote to authorize the Selectmen to grant a lease, development <br /> restriction or conservation easement on a 5.6 acre, more or less, portion of that parcel of land <br /> identified on the FY2000 Mashpee Assessors' Maps as Map 62, Block 67, located between Route <br /> 28, Sampson's Mill Road, Orchard Road and the Willowbend development, to the Mashpee VFW <br /> Post #5489 for the purpose of securing approval under.310 CMR Section 15.216 of an <br /> "aggregation plan" related to approval of a septic system intended to service the proposed VFW <br /> facilities located on a portion of that same parcel which was leased to the VFW by authority of i <br /> the vote under Article 24 of the October 5, 1992 Town Meeting, and to enter into contracts or <br /> agreements in connection with said lease, restriction or easement and execute any and all <br /> instruments as may be necessary on behalf of the Town to effectuate said lease, restriction or <br /> easement; and finally, to authorize the Selectmen, if necessary, to petition the General Court <br /> for special legislation-authorizing the Town to enter into said lease, restriction or easement <br /> notwithstanding any provisions of the Mass. General Laws to the contrary; or take any other <br /> action relating thereto. <br /> Submitted by the Board of Selectmen ; <br /> Explanation: This article would authorize the Board of Selectmen to grant a lease, <br /> development restriction or conservation easement, whichever is most appropriate, to the <br /> Mashpee VFW Post on a parcel of land in addition to that previously leased to the VFW. This <br /> action is necessary to allow the VFW to construct a large enough septic system to serve its <br /> proposed building and meet the 440 gallons per acre limit of wastewater discharge in "Zone II" `. <br /> recharge areas of public supply wells.
