Article 8 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or <br /> otherwise for conservation and passive recreation purposes, that parcel of land identified <br /> on the 2001 Mashpee Assessors' Maps as Map 70, Block 135, consisting of 8000 square <br /> feet, more or less, located at the corner of"Riverview Avenue" and "Laurel Street" and <br /> shown as lots 39, 40, 41 and 42 on a Plan entitled "Cotuit Park in Barnstable County, <br /> Mass. Owned by Charles L. Gifford, Cotuit, Mass." dated January 1, 1914 and recorded <br /> at the Barnstable County Registry of Deeds in Plan Book 1, Page 20, to be held in the <br /> care and custody of the Conservation Commission pursuant to Massachusetts General <br /> Laws Chapter 40, Section 8C; and further, to see if the Town will vote to appropriate <br /> and transfer from the Land Bank Fund established by the Town under the provisions of <br /> Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the Cape Cod <br /> Open Space Land Acquisition Program) $11,900 for such purpose, including expenses <br /> incidental and related thereto; and further, to see if the Town will authorize the Board of <br /> Selectmen and/or Conservation Commission to enter into contracts or agreements with <br /> Federal, State and/or County agencies, private conservation trusts or other entities or <br /> persons in connection with the acquisition of all or a portion of such land and its <br /> preservation for conservation and passive recreation purposes, including enforcement of <br /> conservation restrictions on the land; and finally, to see if the Town will authorize the <br /> Conservation Commission and the Board of Selectmen to enter into agreements and <br /> execute any and all instruments as may be necessary on behalf of the Town to <br /> effectuate said acquisition and preservation; or take any other action relating thereto. <br /> r <br /> Submitted by Open Space Committee <br /> Explanation: This article would authorize the Board of Selectmen to purchase, on <br /> behalf of the Conservation Commission, an 8000 square foot lot adjacent to existing <br /> Town conservation land previously purchased with Land Bank funds appropriated by the <br /> October 1999 Town Meeting, as well as other Town lands acquired through tax takings <br /> and the trade of Lands with Willowbend Development Corporation approved by the <br /> October 2000 Town Meeting. These lands are located on the west side of the Santuit <br /> River between Willowbend, Maushop Stables and the Cotuit Bay Condominiums. Recent <br /> studies by the Public Archaeology Lab indicate that the properties contain extensive <br /> archaeological deposits dating back 5000 years. The property is in the recharge area of <br /> Shoestring Bay and is part of an area recommended as a priority acquisition by the <br /> Comprehensive Plan. <br /> Article 9 <br /> To see if the Town will vote to the authorize the Selectmen to acquire, by purchase or <br /> otherwise, for conservation and passive recreation purposes, all or a portion of that <br /> parcel of land identified on the 2001 Mashpee Assessors' Maps as Map 115, Block 22, <br /> consisting of 7.6 acres, more or less, located between Great Hay Road, Wells Road and <br /> Abigail's Brook, to be held in the care and custody of the Conservation Commission <br /> pursuant to Massachusetts General Laws Chapter 40, Section 8C; and further, to see if <br /> the Town will vote to raise and appropriate, or transfer from available funds, $208,200 <br /> for such purpose, including expenses incidental and related thereto, and to raise such <br /> Page 4 <br /> October 2002 Town Meeting <br />
