f <br /> and to raise such appropriation, the Treasurer, with the approval of the Selectmen, be <br /> authorized to borrow $593,200 or any other sum under and pursuant to Chapter 44, <br /> Sections 7 and 8C and, if applicable, Chapter 40, section 8C of the General laws, or any <br /> other enabling authority, and to issue bonds or notes of the Town therefor; with said <br /> borrowing to be repaid with funds from the Land Bark Fund established by the Town <br /> under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the <br /> Establishment of the Cape Cod Open Space Land Acquisition Program); and further, to <br /> see if the Town will vote to raise and appropriate or transfer from available funds $3,000 <br /> to the Issuance of Debt Account; and further, to see if the Town will authorize the Board <br /> of Selectmen and/or Conservation Commission to apply for and accept Federal, State <br /> and/or County grants, including reimbursement under Chapter 132A, Section 11 of the <br /> General Laws, the "Self-Help Act", to be applied by the Town toward the financing of <br /> this purchase, and to enter into contracts or agreements with Federal, State and/or <br /> County agencies, private conservation trusts or other entities or persons in connection <br /> with the purchase of all or a portion of such land and its preservation for conservation <br /> and passive recreation purposes, including enforcement of restrictions on the land as <br /> required by the provisions of Chapter 293 of the Acts of 1998; and finally, to see if the <br /> Town will authorize the Conservation Commission and the Board of Selectmen to enter <br /> into agreements and execute any and all instruments as may be necessary on behalf of <br /> the Town to effectuate said acquisition and preservation; or take any other action <br /> relating thereto. <br /> Submitted by Open Space Committee <br /> Explanation: This article would authorize the Board of Selectmen to purchase, on <br /> behalf of the Conservation Commission, a 35 acre parcel between Great Oak Road and <br /> Great Hay Road, north of Abigail's Brook, which is surrounded by existing conservation <br /> land owned by the U.S. Fish & Wildlife Service and the Town of Mashpee (the <br /> "Bufflehead Bay" and "Prime View" properties). The area is in the Mashpee national <br /> Wildlife Refuge and in the Zone II recharge area of the Water District's Rock Landing <br /> wells, includes bluffs overlooking marshes and abandoned cranberry bogs along Abigail's <br /> Brook, and is recommended as a top priority acquisition by the Comprehensive Plan and <br /> the Town's open space plan, as well as being a top priority for acquisition within the <br /> Wildlife Refuge. The purchase would be paid for with Land Bank funds. The land is also <br /> proposed to be purchased by the Commonwealth of Massachusetts using federal funds, <br /> and this article is proposed only as a backup in the event that the state purchase does <br /> not occur. <br /> Article 11 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or <br /> otherwise, for the purposes allowed by Chapter 293 of the Acts of 1998, that parcel of <br /> land identified on the FY2001 Mashpee Assessors' Maps as Map 60, Block 1, consisting <br /> of 16,353 square feet, more or less, located off Lowell Road and surrounded by the so- <br /> called "Belcher Property" previously purchased by the Town, along with any appurtenant <br /> easements or rights-of-way; and further, to see if the Town will vote to appropriate and <br /> transfer from the Land Bank Fund established by the Town under the provisions of <br /> Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the Cape Cod <br /> Page 6 <br /> October 2002 Town Meeting <br />
