f and to raise such appropriation, the Treasurer, with the approval of the Selectmen, be authorized to borrow $593,200 or any other sum under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40, section 8C of the General laws, or any other enabling authority, and to issue bonds or notes of the Town therefor; with said borrowing to be repaid with funds from the Land Bark Fund established by the Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition Program); and further, to see if the Town will vote to raise and appropriate or transfer from available funds $3,000 to the Issuance of Debt Account; and further, to see if the Town will authorize the Board of Selectmen and/or Conservation Commission to apply for and accept Federal, State and/or County grants, including reimbursement under Chapter 132A, Section 11 of the General Laws, the "Self-Help Act", to be applied by the Town toward the financing of this purchase, and to enter into contracts or agreements with Federal, State and/or County agencies, private conservation trusts or other entities or persons in connection with the purchase of all or a portion of such land and its preservation for conservation and passive recreation purposes, including enforcement of restrictions on the land as required by the provisions of Chapter 293 of the Acts of 1998; and finally, to see if the Town will authorize the Conservation Commission and the Board of Selectmen to enter into agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate said acquisition and preservation; or take any other action relating thereto. Submitted by Open Space Committee Explanation: This article would authorize the Board of Selectmen to purchase, on behalf of the Conservation Commission, a 35 acre parcel between Great Oak Road and Great Hay Road, north of Abigail's Brook, which is surrounded by existing conservation land owned by the U.S. Fish & Wildlife Service and the Town of Mashpee (the "Bufflehead Bay" and "Prime View" properties). The area is in the Mashpee national Wildlife Refuge and in the Zone II recharge area of the Water District's Rock Landing wells, includes bluffs overlooking marshes and abandoned cranberry bogs along Abigail's Brook, and is recommended as a top priority acquisition by the Comprehensive Plan and the Town's open space plan, as well as being a top priority for acquisition within the Wildlife Refuge. The purchase would be paid for with Land Bank funds. The land is also proposed to be purchased by the Commonwealth of Massachusetts using federal funds, and this article is proposed only as a backup in the event that the state purchase does not occur. Article 11 To see if the Town will vote to authorize the Selectmen to acquire, by purchase or otherwise, for the purposes allowed by Chapter 293 of the Acts of 1998, that parcel of land identified on the FY2001 Mashpee Assessors' Maps as Map 60, Block 1, consisting of 16,353 square feet, more or less, located off Lowell Road and surrounded by the so- called "Belcher Property" previously purchased by the Town, along with any appurtenant easements or rights-of-way; and further, to see if the Town will vote to appropriate and transfer from the Land Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the Cape Cod Page 6 October 2002 Town Meeting
