The Applicant must provide documentation, endorsed by the Board of Health or <br /> its agent,that the proposed accessory apartment conforms with all state and l <br /> town health and sewage disposal regulations. <br /> C. Unit Size. The design, installation, use of an accessory apartment shall be <br /> secondary and incidental to the principal use of the structure as the owner's <br /> home. The gross floor area of the accessory apartment shall be not less than <br /> three hundred (300) square feet nor more than forty percent (40%) of the gross t <br /> floor area of said structure on the date the Special Permit application is filed. <br /> D. Interior Design. The accessory apartment shall be self-contained, with separate << <br /> sleeping, cooking and sanitary facilities for the exclusive use of the occupant(s). I; <br /> Provided that the requirements of subsection B are met, there shall be a <br /> maximum of two (2) bedrooms in an accessory apartment. Rooms which might <br /> ,t. <br /> be converted at some future time to a bedroom, such as studies, studios, <br /> libraries and the like, shall be counted as bedrooms for the purposes of this 11 <br /> Section. <br /> E. Exterior Design. Modifications to the exterior of an existing principal structure <br /> resulting from the installation of an accessory apartment shall be consistent with �< <br /> the principal structure's predominant character as a single-family home. <br /> F. Parking. Notwithstanding the provision of Section 174-39, at least one (1) off- <br /> street parking space shall be provided for the accessory apartment in addition to <br /> any other off-street parking requirement. <br /> G. The Special Permit granted under this section shall run with the property owner <br /> and shall lapse upon sale and/or transfer to another property owner. <br /> H. The accessory apartment shall not be rented or occupied until a Certificate of <br /> Occupancy has been issued by the Building Inspector. <br /> or take any other action relating thereto. <br /> Submitted by Planning Board/ Zoning Board of Appeals <br /> Explanation: This article would allow for the creation of one Accessory Apartment per lot, via <br /> a Special permit from the Zoning Board of Appeals, subject to the criteria outlined in a newly <br /> created §174-45.4. It would eliminate the currently restrictive minimum size requirement of <br /> 750 square feet for an accessory apartment under current zoning. This large size requirement <br /> has prevented property owners from adding a modest accessory unit. <br /> Besides requiring that only the property owner can reside in the primary unit, this section would <br /> Provide a set of design standards in order to ensure that the accessory apartment fits in the <br /> surrounding neighborhood.
