v t Article 20 To see if the Town of Mashpee will vote to exchange 12.83 acres of Town Land not held for conservation purposes for approximately 10 acres of conservation land in the vicinity of the Mashpee River. The Town land is parcels 93-7 (3.26 acres). 93-6 (2.49 acres, and 94-7 (7.08 acres). The site desired is a portion of lots 95-5 (48.5 acres) and lot 95-6 (18.5 acres). All other suitable conservation land sites have conservation restrictions that would preclude their use. Submitted by the Waterways Commission Explanation: This exchange is needed to provide a site for de-watering and disposal of dredged material from navigation channels of the Mashpee River, Ockway Bay, Shoestring Bay, and Popponesset Bay. The only Town land close enough to the salt water that is large enough to accommodate the dredged material (and not in a zone II well recharge area) is now held as conservation land. The Town needs a site that can be used over the long term, when and as needed, to de-water the material dredged form the navigation channels. The material is not suitable for beach nourishment due to its silt content, and cannot be de-watered anywhere that it might affect a potable groundwater supply, or affect fresh-water wetlands. Article 21 To see if the Town will vote that the parcel of land shown on Mashpee Assessors' Maps as Map 93, Block 9 not be held by the Town as conservation land; and further, vote that said parcel shall be transferred from the care and custody of the Tax Collector for the purposes of sale, to the Board of Selectmen, for purposes of sale or lease to a non-profit entity with such transfer to be made subject to a deed restriction, which may contain a reverter clause, restricting the use of said parcel to those uses deemed appropriate by the Board of Selectmen and subject to certain design guidelines and other conditions which the Board may deem appropriate; and finally, to authorize the Board of Selectmen to make use of other instrumentalities of the Town or other agencies and to enter into any agreements necessary, to effect the transfer of such land in accordance with this Article, or take any other action relating thereto. Submitted by the Board of Selectmen Explanation: This article would authorize the selectmen to lease or sell a parcel of land containing approximately 2.44 acres, previously taken by the Town for non-payment of taxes, to an appropriate non-profit entity, which may include a greenhouse as well as a residential home for the disabled. The land would be permanently restricted to uses deemed appropriate by the Board of Selectmen (and would also have to conform to applicable zoning), with design and other conditions specified by the Selectmen, and would be transferred to an agency or organization selected through a "Request for Proposals" process. Under the provisions of Chapter 5, Article VI, Section 5-27 of the Town Code, such a transfer of tax title lands may only occur after the Town has voted whether or not such land should be held as conservation land.
