C. Unit Size. The design, installation, use of an accessory apartment shall be <br /> secondary and incidental to the principal use of the structure as the owner's <br /> home. The gross floor area of the accessory apartment shall be not less than <br /> three hundred (300) square feet nor more than forty percent (40%) of the gross <br /> floor area of said structure on the date the Special Permit application is filed. <br /> D. Interior Design. The accessory apartment shall be self-contained, with separate <br /> sleeping, cooking and sanitary facilities for the exclusive use of the occupant(s). <br /> Provided that the requirements of subsection B are met, there shall be a <br /> maximum of two (2) bedrooms in an accessory apartment. Rooms which migh <br /> be converted at some future time to a bedroom, such as studies, studios, <br /> libraries and the like, shall be counted as bedrooms for the purposes of this <br /> Section. ¢ <br /> E. Exterior Design. Modifications to the exterior of an existing principal structure <br /> resulting from the installation of an accessory apartment shall be consistent with <br /> the principal structure's predominant character as a single-family home. <br /> F,. <br /> F. Parking. Not withstanding the provision of Section 174-39, at least one (1) off- <br /> street parking space shall be provided for the accessory apartment in addition to <br /> any other off-street parking requirement. y <br /> G. The Special Permit granted under this section shall run with the property owner <br /> and shall lapse upon sale and/or transfer to another property owner. <br /> H. The accessory apartment shall not be rented or occupied until a Certificate of ' <br /> Occupancy has been issued by the Building Inspector. <br /> ri <br /> or take any other action relating thereto. <br /> Submitted by Planning Board/ Zoning Board of Appeals C' <br /> Explanation: This article would allow for the creation of one Accessory Apartment per lot via r <br /> a Special permit from the Zoning Board of Appeals, subject to the criteria outlined in a newly7 zr�Ga <br /> created §174-45.4. It would eliminate the currently restrictive minimum size requirement of -x <br /> 750 square feet for an accessory apartment under current zoning. This large size requirement �� <br /> has prevented property owners from adding a modest accessory unit. f .. <br /> Besides requiring that only the property owner can reside in the primary unit, this bylaw would <br /> Provide a set of design standards in order to ensure that the accessory apartment fits in the <br /> surrounding neighborhood. A preliminary review by the Board of Health will be required to <br /> determine if the septic system would permit the additional bedrooms for the accessory <br /> apartment. The standards provide for a maximum of two (2) bedrooms, a square footage size <br /> range so that the accessory unit is within a reasonable scale of the principal unit and gives <br /> some design guidance to ensure that the unit's construction keeps the structure's look as a <br /> single-family home.
