Article 18 <br /> To see if the Town will vote to amend the Zoning Bylaws, Section 174-31, Land Space <br /> Requirements Table by adding the following new R-5A District: <br /> R-5A <br /> Minimum lot size, existing 10,000 square foot lots <br /> Minimum lot frontage, 75 feet <br /> Setbacks, from 25', rear 10, side 10' <br /> Stories, two and a half <br /> Maximum lot coverage, 20% <br /> or take any other action relating thereto. <br /> a Submitted by the Zoning Board of Appeals <br /> Explanation: Resident with undersized lots that are located within the R-5 District, prior to <br /> 2002, will significantly benefit by allowing them to construct or alter their existing dwelling and <br /> meet the less stringent zoning. Allowing this change will not be detrimental to the <br /> neighborhood as this amendment was similar at the time when the homes were constructed, <br /> per M.G.L. 40A, Section 6. <br /> Article 19 <br /> To see if the Town will vote to amend the zoning by-law as follows: <br /> Delete the existing §174-25(A)(8) in its entirety and replace with the following: <br /> "Accessory apartment, subject to the provisions of §174-45.4." Within the Table of Use <br /> Regulations, the letters"SP"shall be inserted under R-3 and R-5,"-" under all other zoning <br /> districts. <br /> In addition, add the following language to a newly created section within Article IX Special <br /> Provisions: <br /> "§174-45.4. Accessory Apartment. <br /> i A Special Permit authorizing one accessory dwelling per lot may be granted if consistent with <br /> the following: <br /> A. In order for an accessory dwelling to be permitted, in addition to meeting all of <br /> the requirements under subsections B-G, the principal dwelling unit shall not be <br /> occupied by anyone other than the property owner as listed on the latest <br /> recorded deed. <br /> B. The Applicant must provide documentation, endorsed by the Board of Health or <br /> its agent, that the proposed accessory apartment conforms with all state and <br /> town health and sewage disposal regulations. <br /> 18 <br />
