1 <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would accept the layout of a proposed "connector road" between the f <br /> Mashpee Industrial Park and the proposed "South Cape Village" shopping center at the corner of <br /> Route 28 and Donna's Lane. The roadway is recommended in the Town's Comprehensive Plan <br /> and is required as a condition of the permits issued for the shopping center by the Cape Cod <br /> Commission and the Mashpee Planning Board in order to reduce future curb cuts and traffic <br /> congestion on Route 28. The entire cost of laying out and constructing the road is being paid by <br /> the developer of the shopping center. <br /> Motion made by David Leveille. <br /> Motion: I move Article 22 be voted as printed in the warrant, with the exception of the phrase, <br /> "or take any other action relating thereto" and with the clerical correction of changing the date of <br /> the plan from "April 7, 2003"to "March 18, 2003 as revised on April 3, 2003". <br /> Planning Board voted at a Public Hearing held on April 2, 2003 5-0 for approval. <br /> I <br /> Motion passes unanimously at 9:33 p.m. f <br /> i <br /> Article 23 <br /> i <br /> To see if the Town will vote that the parcel of Town-owned land shown as "Parcel D" on a plan <br /> entitled "Right of Way Layout Plan, Commercial Street, Mashpee, MA" by Baxter, Nye & <br /> Holmgren, Inc., dated April 7, 2003, which is that portion of the parcel shown on the 2002 <br /> Mashpee Assessors' Maps as Map 81, Block 21 lying east of the proposed "Commercial Street" +. <br /> shown on said plan, shall not be held by the Town as conservation land; and further, vote that <br /> said parcel shall be transferred from the care and custody of the Tax Collector for the purposes of ! <br /> sale, to the Board of Selectmen for purposes of sale or lease to a non-profit entity or entities, with <br /> such transfer to be made subject to a deed restriction, which may contain a reverter clause, ' <br /> restricting the use of said parcel to those uses deemed appropriate by the Board of Selectmen and i nil; <br /> subject to certain design guidelines and other conditions which the Board may deem appropriate; <br /> and finally, to authorize the Board of Selectmen to make use of other instrumentalities of the <br /> Town or other agencies and to enter into any agreements necessary, to effect the transfer of such j <br /> land in accordance with this Article, or take any other action relating thereto. <br /> i <br /> Submitted by the Board of Selectmen <br /> i <br /> �f Hai <br /> Explanation: This article would authorize the selectmen to lease or sell a parcel of land <br /> containing approximately 6 acres located east of Route 28 on a proposed street called <br /> "Commercial Street", previously taken by the Town for non-payment of taxes, to an appropriate <br /> non-profit entity, which may include a non-profit inn and conference center proposed by the <br /> Doreen Grace Fund. The land would be permanently restricted to uses deemed appropriate by <br /> the Board of Selectmen (and would also have to conform to applicable zoning), with design and <br /> other conditions specified by the Selectmen, and would be transferred to an agency or <br /> organization selected through a "Request for Proposals" process. Under the provisions of <br /> Chapter 5, Article VI, Section 5-27 of the Town Code, such a transfer of tax title lands may only <br /> 24 <br />
