TOWN OF MASHPEE <br /> Petitioner: Richard Landry July 10, 1973 <br /> Hearing: June 12, 1973, 8:PM <br /> Place: Mashpee Town Hall <br /> Appeals Board: P.M.Lawrence, Frank Hickey Kevin O'Connell <br /> FACTS <br /> The petitioner applied for a Special Permit to construct and operate a school for <br /> the instruction of Minor Sports and more particularly, the Art of Judo. The petitioner <br /> has had an intensive background in the instruction of such sports. The school is to be <br /> a non-profit organization with the cost of the training to cover only the cost, of the <br /> building and the payment of the instructors. <br /> The land on which the school is to be constructed is located in an R-2 area* located <br /> on the corner of Rt. 28 and High Sachem Road. The zoning by-laws of the Town Of Mashpee <br /> allow for the issuance of a Special Permitunder Sec. 6.3, part 13 which states: <br /> " our c1yb,.miyiatuj golf, swimming, tennis# or other recreational <br /> acr r y o srmi ar na u e <br /> The petitioner presented architectural drawings of the proposed building and outlined <br /> the program to be taught. <br /> DECISION <br /> The Board issues a Special Permit for the operation of a school for the instruction <br /> of Minor Sports to the petitioner with the following conditions: <br /> A. The building shall be set back at least 50 feet from Rt. 28, and the 50 <br /> foot buffer zone shall be left in a natural state creating a screen so as <br /> not to be visible from Rt. 28. <br /> B. The building shall be set back at least 50 feet from High Sachem Rd. and <br /> the 50 foot buffer zone shall only be used for parking leaving at least <br /> 10 feet from High Sachem Rd. in a natural state. The Board reserves the <br /> right to request further screening if deemed necessary. <br /> C. The parking area shall conform to current requirements as established under <br /> the 1971 Zoning By-law. <br /> D. No signs or advertising devices shall be visible from Rt.. 28.
