TOWN OF MASHPEE <br /> Petitioner: Gerald Unina Ju <br /> Hearing: June 20, 1973 <br /> Time: 8:PM <br /> Place: 14ashpee Town Hall <br /> Board: P.M.Lawrence, Frank Hicks+ Randolph Peters <br /> FACTS <br /> The petitioner requests a variance from Sec. 7.4 of the Zoning Laws of 1971. He <br /> requests the variance for a parcel of land located on the Wezterlg' side of Rt. <br /> 289 south of Pine Tree Corner, and shown in Plan Book 194. page 39, at the Barn- <br /> stable County Registry of Deeds. The petitioner'currently has the property under <br /> agreement with the current owner Herbert L. Fox. The petitioner requests that he <br /> be allowed to construct an office building on the property and asks that the min- <br /> imum lot size of 40.000 square feet be varied to 38,688 square feetv and that he <br /> be allowed to build 100 feet from the front lot line rather than 150 feetr and <br /> also to build to 40 feet of the rear lot line rather than the 50 feet required by <br /> current zoning law. <br /> DECISION <br /> The board finds that the-lot under current zoning standards creates a hardship <br /> for the petitioner and owner. Zoning Laws of the Town of Mashpee for Light. In- <br /> dustrial Areas allow for the construction of professional offices, however the <br /> lotin question would not allow for the building of such offices unless the re- <br /> quirements are varied. The Board of Appeals considers office usage as a desirable <br /> land use and therefore issues a Special Permit to the petitioner with the follow- <br /> ing conditions: <br /> A. The petitioner shall deliver to the Board of Appeals architectural <br /> drawings and floor plans of the proposed structure. <br /> B. The structure must be set back at least 108 feet from the front lot <br /> line. The stucture shall be built no closer to the rear lot line than <br /> 40 feet. The side line requirements. for Light Industrial Areas shall <br /> remain at 30 feet. <br /> C. The area for parking shall conform to current zoning standards with <br /> the exception that no parking will be allowed within 35 feet of the f <br /> front lot line. <br /> D. The area within the 40 foot buffer zone shall remain in a natural state <br /> except for the entrance drive. <br /> E. The Appeals Board reserves the right to require further screening from <br /> the road if the necessity arises concerning the aesthetic character of <br /> the lot. <br /> F.
