Goulet <br /> DECISION <br /> A petition was duly filed by the petitioner for a variance to Section 7.4 <br /> Land Space requirements of zoning By-law as pertains to side line requirements in <br /> R-2 zoned area. <br /> Notice was duly given to abutters and owner of land next adjoining the land of <br /> abutters. Notice was given by publication in the Falmouth Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee on November 7 and November 14, 1975, <br /> a copy of such notice being appended hereto. <br /> A public hearing was held on the petition at the Mashpee Town Hall on Monday, <br /> November 24, 1975 at 7:30 p.m. at which time the following members of the Board of <br /> Appeals were present: Clara L. Keliinui, Chairman, Michael Makunas and John Boyle. <br /> The petitioners property consists of land and dwelling located on Monomoscoy Road. <br /> Dimensions of lot are 80 foot frontage and 100 foot depth. Petitioner is desirous <br /> of enlarging the two bedrooms on the southwesterly side of existing dwelling by <br /> extending dwelling 10 feet which would reduce sideline to 5 feet. The sideline <br /> requirement is 15 feet. The property line between petitioner's property and abutter <br /> is densely treed and the proposed extension of dwelling would not have exterior <br /> doors. <br /> No objections to the granting of a variance were received prior to the public <br /> hearing nor was there anyone in attendance voicing objection. The petitioner and <br /> his wife were the only persons attending hearing. <br /> It was unanimously voted by the Appeals Board to grant a variance from sideline <br /> requirements permitting petitioner to extend bedroom wing on southwesterly sideline <br /> to within 5 feet of lot line. <br /> Under provisions of Chapter 40A, Zoning Enabling Act as amended, petitioner is <br /> required to record this variance at Barnstable County Registry of Deeds and satisfy <br /> arty and all costs related thereto. n <br /> Clara L.
