Sprout <br /> DECISION <br /> i <br /> j A petition was duly filed by the petitioner for a variance to Section 7.4 <br /> Land Space requirements of zoning by-law as pertains to side line requirements <br /> in R-2 zoned area. <br /> Notice was duly given to abutters and owner of land next adjoining the .land <br /> of abutters. Notice was given by publication in the Falmouth Enterprise, a news- <br /> paper of general circulation in the Town of Mashpee on December '2 and. December 9, <br /> 1975, a copy of such notice being appended hereto. <br /> A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, <br /> December 17, 1975 at 8:00 p.m. at which time the following members of the Board of <br /> Appeals were present: Clara L. Keliinui , Chairman, John Boyle, and David Keene. <br /> Petitioners property consists of land and dwelling located on Central Avenue, <br /> Seconsett Island, dimensions of lot are 124.17 feet frontage and 126.75 foot depth. <br /> Petitioner wishes to construct a 20 foot by 24 foot garage on premises. In order to <br /> situate garage on property in the proper perspective, petitioner is requesting relief <br /> of 5 feet on the southerly lot line which would allow a 10 foot sideline rather than <br /> the required 15 feet. <br /> No objections to the granting of a variance were received prior to the public <br /> hearing nor was there anyone in attendance voicing objection. A letter was received <br /> from Jacques A. Laus, owner of property immediately abutting petitioners' property <br /> on the lot line in question. Mr. Laus states that he has no objection to a variance <br /> being granted. <br /> It was unanimously voted by the Appeals Board to grant a variance from sideline <br /> requirements permitting petitioners to construct a 24 foot by 20 foot garage 10 feet <br /> from lot line on the southerly side of their property located on Central Avenue, <br /> Seconsett Island. <br /> Under provisions of Chapter 40 A, Zoning Enabling Act as amended, petitioners <br /> are required to record this variance at Barnstable County Registery of Deeds and satisfy <br /> any and all cost related thereto. <br /> Clara L.
