Gilmore d/b/a Gilmore Paving <br /> and Contracting, Inc. , for a Special Permit to <br /> process and remove sand, gravel, topsoil and subsoil. <br /> FACTS <br /> A petition was duly filed by petitioner for a Special Permit under <br /> provisions of Section 6. 3 H5, Land Use Regulations of the zoning by-law <br /> as pertains to stripping of loam, peat, sand and gravel in industrial <br /> zoned area. <br /> Notice was duly given to abutters and owners of land next adjoining <br /> the land of abutters. Notice was given by publication by publishing in <br /> the Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee, on April 20 and April 27, 1976, a copy of such notice being <br /> appended hereto. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, May 5, 1976 at 7: 30 P.M. at which time the following mem- <br /> bers of the Board of Appeals were present: Clara L. Keliinui, Chairman; <br /> Michael Makunas and Linda E. Hendricks. <br /> The petitioner' s property consists of 32. 08 acres of land fronting <br /> on Route 130 for a distance of 1000 feet, .north of Mashpee Town Hall <br /> Building, with a depth of approximately 2660 feet abutting Otis Air <br /> Force Base. There is an existing sand pit on property. The property <br /> fronting on Route 130 is zoned commercial for a depth of 400 feet. <br /> There are no buildings on property. Property bordering on the north <br /> and south of petitioner' s property is zoned industrial. <br /> No written objections to the granting of a special permit were <br /> received prior to the hearing and no objections were voiced at the <br /> hearing. Several persons attending the hearing spoke in favor of special <br /> permit and one letter was received favoring special permit. A letter <br /> was received from Planning Board favoring special permit only if the <br /> mining of gravel is used in conjunction with the operation of the <br /> batching plant. <br /> DECISION <br /> It was unanimously voted by the Appeals Board to grant a special <br /> permit to petitioner authorizing the processing and removal of sand, <br /> gravel, *topsoil and subsoil. There is a need for such a business in <br /> the Town; job opportunities would be created and a substantial tax <br /> base is u'ld be realized. The plant will be appropriately located in an <br /> industrial area situated on the northwesterly perimeter of the town and <br /> Otis Air Force Base. There is no aspect of this operation that the Board <br /> of Appeals feels will be detrimental to the town by reason of excessive <br /> traffic, noise, or contribution to health and safety hazard. <br /> Page one <br /> 1 <br />
