r •
TOWN OF MASHPEE
BOARD OF APPEALS
TOWN HALL, MASHPEE, MASSACHUSETTS 02649
rye co
Re: Petition of Wayne H. Gilmore d/b/a Gilmore Paving
and Contracting, Inc. , for a Special Permit to
process and remove sand, gravel, topsoil and subsoil.
FACTS
A petition was duly filed by petitioner for a Special Permit under
provisions of Section 6. 3 H5, Land Use Regulations of the zoning by-law
as pertains to stripping of loam, peat, sand and gravel in industrial
zoned area.
Notice was duly given to abutters and owners of land next adjoining
the land of abutters. Notice was given by publication by publishing in
the Falmouth Enterprise, a newspaper of general circulation in the Town
of Mashpee, on April 20 and April 27, 1976, a copy of such notice being
appended hereto.
A public hearing was held on the petition at the Mashpee Town Hall
on Wednesday, May 5, 1976 at 7: 30 P.M. at which time the following mem-
bers of the Board of Appeals were present: Clara L. Keliinui, Chairman;
Michael Makunas and Linda E. Hendricks.
The petitioner' s property consists of 32. 08 acres of land fronting
on Route 130 for a distance of 1000 feet, .north of Mashpee Town Hall
Building, with a depth of approximately 2660 feet abutting Otis Air
Force Base. There is an existing sand pit on property. The property
fronting on Route 130 is zoned commercial for a depth of 400 feet.
There are no buildings on property. Property bordering on the north
and south of petitioner' s property is zoned industrial.
No written objections to the granting of a special permit were
received prior to the hearing and no objections were voiced at the
hearing. Several persons attending the hearing spoke in favor of special
permit and one letter was received favoring special permit. A letter
was received from Planning Board favoring special permit only if the
mining of gravel is used in conjunction with the operation of the
batching plant.
DECISION
It was unanimously voted by the Appeals Board to grant a special
permit to petitioner authorizing the processing and removal of sand,
gravel, *topsoil and subsoil. There is a need for such a business in
the Town; job opportunities would be created and a substantial tax
base is u'ld be realized. The plant will be appropriately located in an
industrial area situated on the northwesterly perimeter of the town and
Otis Air Force Base. There is no aspect of this operation that the Board
of Appeals feels will be detrimental to the town by reason of excessive
traffic, noise, or contribution to health and safety hazard.
Page one
1
