. -Petition of Wayne H. Gilmore for Special Permit (Cont' d) <br /> CONDITIONS <br /> 1. The active gravel removal operation shall not exceed a total area <br /> of five (5) acres at any one time. <br /> 2. A $5, 000. 00 bond guaranteed by a surety company licensed to do <br /> business in Massachusetts shall be posted for each five (5) acres of <br /> operation area. Bond will be released only after necessary steps have <br /> been taken to restore land in accordance with applicable town regulations <br /> and conditions set forth in this special permit. <br /> 3. No excavation will be closer than 450 feet from Route 130 and <br /> no excavation will approach neighboring lot lines closer than 50 feet. <br /> 4. Access road leading to Route 130 shall be treated with oil, <br /> stone or other suitable material to reduce dust and mud for a distance of <br /> 400 feet back from Route 130. Any spillage on public ways must be cleaned <br /> up by operator. <br /> 5. Access road shall be constructed at angle to Route 130 to help <br /> screen operation from public view. <br /> 6. Permanent drainage shall be provided to eliminate free standing <br /> water. <br /> 7. A substantial stockpile of topsoil and subsoil will be maintained <br /> for restoration of each five (5) acre operation area. <br /> 8. Within 6 months after termination of gravel operations, all <br /> equipment, buildings, structures and other evidence of operation shall <br /> be removed from premises. <br /> 9. Raw material shall not be removed from the town either by <br /> petitioner or sold to persons who intend to move material from the town, <br /> except as a finished product such as concrete, bituminous concrete, <br /> crushed stone, and washed sand. <br /> 10. The Police Chief will require traffic signs and other safety <br /> measures he deems necessary for the protection of motorists and pedestrians. <br /> 11. Gravel pit shall be inspected by the Conservation Commission or <br /> their agent at least semi-annually to determine whether or not all condi- <br /> tions are being met. If it is determined that the operation is in <br /> violation of conditions set forth and local ordinances, the Appeals Board <br /> reserves the right to terminate this special permit. <br /> 12.
