FOR SPECIAL PERMIT <br /> CASE NUMBERFINDING• OF 'FACTS <br /> The Mashpee Board of Appeals held a hearing on August 17 , 1983 <br /> on the application for a Special Permit for Alan Industries , Inc. <br /> to use premises situated at the Rotary Circle and Great Neck Road <br /> in a C-1 district for sales , rentals and storage of audio visual <br /> equipment including a mobile 'satellite dish which is stored , when <br /> not out on rental, approximately 40 feet from the corner of the <br /> building as is shown on a plan of land. bearing the approval of <br /> the Building Inspector dated July 8, 1983. <br /> A copy of the application for the Special Permit and the attached <br /> plan are annexed to this decision. <br /> Notice of the hearing was published in th.e Falmouth Enterprise <br /> on August 2 , 1983 and August 9 , 1983. The application for Special <br /> Permit was not filed by the applicant with th.e Town Clerk until <br /> August 9 , 1983. <br /> Board members present and voting on this application were Chairman <br /> Manuel Costa, and members Virginia Landry and Peter Lawrence. <br /> Alan Mendleson appeared on behalf of Alan Industries , Inc. , He <br /> indicated to the Board that he presently has a Special Permit <br /> permitting him to engage in the business of video, movie and <br /> audio visual equipment rental and storage . He indicated to the <br /> Board that what he sought in this application for S.pecial Permit <br /> was to change his permit to give up the movie and TV sales and <br /> rental part of. his current business , and further that this was <br /> conditional upon the grant of a Special Permit to Margo Wharton <br /> to conduct that the same kind of business at the old package store <br /> located on the Mashpee Rotary . He said that his present Special <br /> Permit was to be modified to reflect this change . <br /> Mr. Mendleson indicated that he was filing this application <br /> pursuant to Section 6 . 3. E. 4 of the Zoning By-Law which provides <br /> for the grant of aSpecial Permit in the C-1 business district <br /> to permit a service business serving local needs to operate . <br /> The Board noted that a previous Special Permit had been granted to <br /> Mr. Mendleson on December 6 , 1982 to operate a video and audio visual <br /> equipment rental store. The Board further noted that this earlier <br /> Special Permit did not refer to th.e mobile satellite dish referred <br /> to in the application now before the Board. The Board further noted <br /> that this mobile satellite dish had been the subject matter of <br /> litigation between Harold P. Collins the Building Inspector , and <br /> the applicant Alan Industries . The Board noted that accompanying the <br /> application for Special Permit which. was filed with the Town Clerk <br /> on August 9 , 1983 , was a plan of Locus which had a notation thereon <br /> as follows : "the satellite dish is to be placed on the pavement <br /> approx. 40 ' from corner of the building that arrow indicates .
