The Board further <br /> noted that Town Counsel had informed the Board that the <br /> litigation between the Building Inspector and Alan Industries over <br /> the satellite dish had been resolved by agreement of the Building <br /> Inspector and Alan Industries and that a Stipulation would be <br /> filed with the Court . <br /> Mr. Mendleson indicated to the Board that his dispute with the <br /> Building Inspector had been settled and that he was moving the <br /> satellite dish back from its pres'ent location and that he and <br /> the Building Inspector had agreed on the same. He referred to <br /> the plan which he had attached to his application , and pointed <br /> out to the Board the signature of Harold P . Collins and he <br /> indicated that the "X" shown on the plan is where the satellite <br /> dish would be moved to. <br /> Mr. Mendleson indicated that he did not feel the satellite dish <br /> was a visual eyesore . He indicated that modern technology would <br /> require satellite dishes to be in use with increasing frequency . <br /> He agreed that he would not have any advertising on his satellite <br /> dish , and that the same would not be easily seen from the road , <br /> but would be removed to the rear area of the building. <br /> The Board held up its decision on the Special Permit at the request <br /> of Mr. Mendleson because of difficulty encountered by Margo Wharton <br /> with her lease arrangement . On November 15 , 1983 , Alan Industries , <br /> Inc. requested in writing that the Board extend the time for <br /> rendering its decision for an additional 90 days because of a <br /> representation that Margo Wharton would be reapplying for a <br /> Special Permit . <br /> On December 21 , 1983, Mr. Mendleson appeared before the Board and <br /> spoke on behalf 'of the application for Special Permit of Margo Wharton <br /> and reminded the Board that his application for Special Permit was <br /> still pending and could now be acted on. <br /> The Board noted that it had received and had in its file a copy <br /> of the Judgment on Stipulation which had been entered in the <br /> Superior Court action and that the same appeared to conform to <br /> the plan and the representation made by Mr. Mendleson at the <br /> original hearing on August 17 , 1983 . <br /> DECISION <br /> The Board of Appeals unanimously approves the application for a <br /> Special Permit of Alan Industries for permission to operate a <br /> business pursuant to Section 6. 3. E . 4 of the Zoning By-Law for the <br /> conduct of a service business for the sale, rental ans storage <br /> of audio visual equipment , so long as the same is located entirely <br /> within the structure of the building housing the operation in the <br /> C-1 business zone , except -bhat the applicant may store a mobile <br /> (mounted on a trailer) satellite dish approximately 40 feet from <br /> the northeast corner of the building as is shown on the plan <br /> dated July 8 , 1983, signed by Alan W. Mendleson and approved by <br /> Harold P. Collins , submitted by applicant , a copy of which is <br /> attached hereto . The satellite dish is not to have any lettering <br />
