TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> 5 TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> RE: Petition of Edward R. Wasil for a Special Permit Case #SP-84-3-007 <br /> FACTS <br /> A Petition was ifled by Edward R. Wasil of Mashpee, Massachusetts for <br /> aSpecial Permit for permission to construct and use a building on property <br /> located on Route 28, Mashpee, Massachusetts for a multi-purpose building to be <br /> used as an Indoor Flea Market, Auction Gallery, Social Function Room(s) , <br /> Entertainment and Snack Bar, pursuant to Sub-Sections B.14, E.1 and E.2 <br /> of Section 6.3 of the Zoning By-Law. Locus is in a C-1 zone. <br /> Notice was duly given to abutters in accordance with M.G.L.A. Chapter 40A. <br /> Notice was given by publication in the Falmouth Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee on February 21, 1984 and <br /> February 28, 1984, a copy of which .is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 7, 1984 at 7:30 p.m. , at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, Peter Lawrence and Virginia Landry. . <br /> Attorney Raymond Sweeney appeared for the applicant and presented his <br /> position and request to the Board. Discussion ensued relative to the plans <br /> submitted by the applicant and the review recommendations of the Design <br /> Review Committee which were shared by the Board. The applicant agreed to <br /> revise the plans to conform to these recommendations and modifications. <br /> There was no one in opposition to the request of petitioner and the <br /> Board continued the hearing to April 4, 1984, to allow petitioner to <br /> modify his plans in accordance with the items discussed. <br /> On April 4, 1984, Attorney Raymond Sweeney'appeared before the Board <br /> and the plans, as modified and approved by the Design Review Committee <br /> were reviewed. The Board made several comments relative to the plans <br /> concerning landscaping and accepted the recommendations of the Design <br /> Review Committee, as modified by the Board. <br /> Discussion was had relative to the .intended use of the building for <br /> a Social Function Room and as a place for Entertainment. Mr. Sweeney assured <br /> the Board that no night club activity was contemplated nor would the <br /> building be used for rock concerts or other live entertainment to which <br /> young people would come. He stated that no alcohol beverage license <br /> would be sought and that use of the premises would be limited to flea <br /> market and auction sales. He further offered that any other use would <br /> not be made unless the applicant requested a special permit therefor from <br /> the Board. <br /> After discussion, the Board agreed to hold a special meeting on <br /> Monday, April 9, 1984 at 7:00 p.m. to act upon the application. <br />
