DECISION <br /> The Board voted unanimously to grant the Special Permit for an Indoor <br /> Flea Market and Auction Gallery pursuant to Section 6.3.E.1 and for a <br /> Snack Bar pursuant to Section 6.3.E.2, subject to the imposition of the <br /> following conditions as to use and the Board found that these conditions <br /> would be adequate to insure that the proposed use would not be detrimental <br /> to the neighborhood or the general welfare of the inhabitants of the Town <br /> and would be consistent with the general purpose and intent of the Zoning <br /> By-Law. <br /> No action is taken on the request for Entertainment and Social <br /> Function Room(s) as the applicant indicated he would apply for a Special <br /> Permit for the same if and when the need arose and did not need to have <br /> the Board decide on that part of the request. <br /> Therefore, the Board finds that the petitioner has withdrawn that <br /> part of his application seeking Entertainment and Function Room(s) approval <br /> and consequently takes no action thereon. <br /> CONDITIONS <br /> 1. The approved landscaping, parking, building and plot plan, which <br /> shows the building, landscaping, parking spaces, traffic flow, ingress <br /> and egress to and from locus, shall be followed by the petitioner in <br /> all respects and prior to opening for business the petitioner shall <br /> notify the Building Inspector, in writing, and he will review the site <br /> and authorize petitioner in writing to open for business if all conditions <br /> and requirements have been complied with or satisfied. <br /> 2. In lieu of immediate completion of landscaping and other improvements <br /> as shown on the plans, the petitioner may post a bond with surety approved <br /> by the Board of Appeals or cash surety, in the amount of $21,000 in a <br /> form acceptable to the Board conditioned upon the completion of all <br /> landscaping not later than three (3) months from the date of issuance of <br /> the occupancy permit by the Building Inspector. The bond shall be filed <br /> with the Board within two (2) weeks of the issuance of the building permit. <br /> When landscaping and the improvements are completed, as certified in <br /> writing by the Building Inspector and accepted, the bond shall be <br /> returned to the petitioner. The bond will be held by the Town Treasurer. <br /> 3. The petitioner shall comply with all requirements of the State <br /> Building Code, the State and Town Health Codes and all rules and regulations <br /> promulgated by the State and Town governing the use of the building. <br /> 4. No alcoholic beverages shall be sold or served except on occasions <br /> when petitioner has obtained an occasional daily license for the same <br /> from the Board of Selectmen. <br /> 5. All parking shall be on-site and there shall be no off-site parking <br /> allowed on or beside any adjacent or abutting ways. <br /> 6. There shall be no outside storage or merchandise or goods nor shall <br /> there be any outside sales activity. All display and sale activity <br /> shall be indoors. All food service and sales shall be indoors and shall <br /> be limited to on-premises consumption. <br />
