Labute for a Special Permit Case <br /> #SP-85-05-023 <br /> A petition was filed by Henry C. Labute of Mashpee, Massachusetts <br /> for a Special Permit for permission to cluster subdivide on property <br /> located on William Mingo Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massach- <br /> usetts General Laws Chapter 40A. Notice was given by publication - <br /> in the Falmouth Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on May 8, 1985 and May 15. 1985 a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, May 22, 1985 at 7 :30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Manuel Costa and Michael Makunas. <br /> Bruce Gilmore represented Mr. Labute in this matter. There are <br /> 48 proposed lots. At this time the Board requested that the lot <br /> 1 <br /> lines for lots 36 and 37,be' redefined as , there was an ancient way <br /> going through them. In addition the Board requested that the formula <br /> on the plan be changed showing a possible barn, the calculations were <br /> to show the amount of open space with the barn and ancient ways as <br /> part of the plan. The application was taken under advisement at this <br /> time. <br /> On June 12, 1985 the Board accepted plans showing the changes <br /> requested. On June 26, 1985 the Board voted to grant the Special <br /> Permit with conditions. <br />
