TOWN OF MASHPEE <br /> - � BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PAg DECISION <br /> REs Petition of Shellback Way Realty Trust for a Variance Case <br /> #V-85-0?-039 <br /> A Petition was filed by Shellback Way Realty Trust of Mashpee, <br /> Massachusetts for a Variance for permission to vary the front yard <br /> setback as it relates for parking areas in an Industrial zoning <br /> district on property located on Route 28, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> d <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on June 26 , 1985 and July 3, 1985 a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, July 10, 1985 at 7 :30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Manuel Costa and Micharel Makunas. <br /> According to the new By-law the 100 foot buffer zone is to <br /> remain intact in the natural state. Mr. Dunning said that a sub- <br /> section of the Section ?.4 had been ammended and that they did ask <br /> for relief under that section. Most of the land in this area. is <br /> filled and was filled when the nursing home was constructed,. this <br /> land has already been disturbed. Mr. Dunning asked that .their <br /> variance application also include this. He also felt that this new <br /> By-law was meant to apply to industrial sections and may have con- <br /> templated heavy industrial use as opposed to this light professional <br /> office use and that perhaps the idea of screening this from public <br /> view may not be as necessary. <br />
