MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> 1 <br /> Re: Petition of Ted Houghton for a Variance - (Owners of record: <br /> Amir and Ethel Bornstein) - Case: V-88-06-044 <br /> A Petition was filed by Ted Houghton of Marstons Mills, Massachusetts <br /> 1 <br /> for a Variance under Section 7.4 of the Land Space Requirements for <br /> permission to vary the sideline setback requirements in an R-3 <br /> zoning district on property located on 210 Simons Narrows Road <br /> (Map 76, Lot 89) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee, on May 25 and June 1, 1988, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, June 8, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Edward Govoni. The hearing <br /> was continued on July 13, 1988. <br /> Counsel, representing the applicant, explained that Mr. Houghton <br /> had built the house for the Bornsteins and had received a Certificate <br /> of Occupancy on 6/11/87. It was later discovered that the sideline <br /> setback did not meet zoning requirements and Mr. Houghton was of the <br /> opinion that the side stakes had been moved since the original survey. <br />
