Damon for a Special Permit SP-89-11-108 <br /> A Petition was filed by David and Diana L. Damon of Mashpee, <br /> Massachusetts for a Special Permit for permission to build ramps, <br /> boardwalk and floats in an R-3 zoning district on property located <br /> at 89 Whippoorwill Circle (Map 125, Block 153) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on December 11 and 18, 1989, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, December 27, 1989 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Edward M. Govoni and John J. Friel. . <br /> The Board was informed that a similar petition had been heard <br /> by the Board on July 26, 1989 and denied without prejudice. The Board <br /> determined at that time that the plans presented were incomplete and <br /> lacking in engineering detail. David A. Jones, engineer, advised <br /> the Board that the plans had been revised and they had added chain and <br /> pilings to the original plan. <br /> Mr. Robert Gray of Sabatia reviewed the results of a shellfish <br /> study he had conducted at the site on August 30, 1989. He reported <br /> that the results indicated that the number of quohogs in the area <br /> were in the recreational category and the number of clams were above <br /> the recreational category. <br />
