BOARD OF APPEALS David W. and Diana L. Damon SP-89-11-108 Page 2.
Paul Somerville, Shellfish Constable, stated that he had not
received the shellfish survey prepared by Sabatia. He informed
the Board that this area of Great River is a productive resource
area. He stated that there are several other structures of similar
design in the immediate area. He explained that seasonal floating
docks present potential problems by limiting access to shellfish
under the float and the possibility of damage to the shellfish
beds from vessels grounding out.
Robert Sherman, Conservation Agent, stated that he considered
the construction and use of the dock would cause substantial
disruption to the shellfish habitat.
The Board of Appeals, after carefully considering all of the
facts and evidence submitted at the hearing, makes the following
findings:
1. The Board determined that the petitioner failed to meet
the conditions necessary for the granting of a Special Permit.
2. There was not sufficient evidence that the use is in harmony
with the general purpose and intent of the zoning by-laws.
3. There was not sufficient evidence that the use complies
with the general or specific provisions set forth within
the zoning by-laws.
Upon motion duly made and seconded, the Board of Appeals
voted unanimously on December 27, 1989 to deny the petition
without prejudice.
. b . . r •
r •ti - Q w
JAN 1 1t 1990
