BOARD OF APPEALS Minutes July 26, 1989 Page 2. <br />• Mr. Friel asked if a restaurant might occupy the site. Mr. Ferragamo <br />responded that they had no plans for a restaurant or any waste -producing use <br />of the space. <br />Mr. Makunas stated that he felt a Variance was necessary on the lot <br />coverage within the Groundwater Protection District. <br />Mr. Halpern moved to grant a Variance from Section 11.B.5.H to allow <br />for an increase from 30% to 39% of lot coverage rendered impervious by <br />buildings or pavement. Mr. Friel seconded. All agreed. <br />Mr. Makunas asked if any landscaping bids had been submitted on the <br />property. Mr. Ferragamo responded that he did not expect that there would <br />be $10,000 worth of plantings.. There was discussion on the legality of <br />requiring the posting of bonds for landscaping performance. <br />Mr. Halpern moved to grant the Special Permit. Mr. Makunas asked <br />for an amendment to the motion to include bond requirement. <br />Mr. Halpern moved to grant the Special Permit as requested with the <br />condition that a $10,000 landscaping bond or letter of credit be posted <br />with the Town Treasurer before a building permit was issued. Mr. Friel <br />seconded. All agreed. <br />David W. Damon - (Owner of record: David W. and Diana L. Damon) <br />• Request a Special Permit under Section 6.3.1.9 for permission to <br />build ramps, boardwalk and floats in an 77-3 zoning district on property <br />located at 89 Whippoorwill Circle (Map 125, Block 153) Mashpee, MA. <br />Members sitting: Michael Makunas, Richard Halpern, Edward Govoni <br />David W. Damon represented his application. He explained his plans <br />for a dock which would be removed in the winter. Members of the Board <br />reviewed the plans. Mr. Halpern stated that the plans were lacking in <br />identification of poles to hold the floats. Mr. Makunas asked how <br />floats would be connected and Mr. Damon replied that chains and eyebolts <br />would be used. Mr. Makunas said plans were lacking in engineering <br />detail. <br />Direct abutters Lincoln and Sheila Krauter spoke in favor of the <br />petition. <br />Paul Somerville, Shellfish Constable, said that he did not receive <br />plans until July 7 although plans were filed with the Town Clerk on <br />June 14, 1989. He said the circumstances were similar to that of the <br />Malloy dock in the neighborhood to which he was opposed. He informed <br />the Board that neither he nor the Conservation Commission has had time <br />to review the details of the petition. <br />Mr. Govoni and Mr. Halpern informed Mr. Damon of the requirement <br />to allow a 5' height clearance to provide public access under the dock. <br />• Comments were received from the Conservation Commission asking <br />for additional time and more complete plans. <br />
