BOARD OF APPEALS <br />• MINUTES <br />July 26, 1989 <br />At 7:30 p.m. on Wednesday, July 26, 1989 the Board of Appeals <br />held a meeting at the Mashpee Town Hall. Board members present and <br />acting throughout were: Michael A. Makunas, Edward M. Govoni, <br />Richard E. Halpern and John J. Friel. Douglas S. Boyd, Building <br />Inspector, was in attendance. <br />Anthony E. Ferragamo - (Owner of record: Forestdale-Echo Realty <br />Trust) - Requests a Special Permit under Section 6.2 and 6.3 of the <br />Zoning By-laws for permission to build an office/retail complex and <br />a Variance under Section 11B.5.1 (h) for permission to vary the lot <br />coverage in a C-2 zoning district on property located at 548 Main St. <br />(Map 20, Block 47) Mashpee, MA. <br />Members sitting: M. Makunas, R. Halpern,J. Friel <br />Attorney Kevin Kirrane represented the applicant. He informed <br />the Board that the lot consists of 33,541 square feet on Route 130 <br />near Echo Road. The applicant proposes to construct a two-story <br />wood frame structure of 3,060 sf coverage. The lot is a pre-existing <br />• nonconforming lot created in 1986 prior�to the adoption of new <br />regulations relating to the C-2 zoning kdistrict. <br />Mr. Kirrane explained that the lot had an Approval Not Required <br />Plan endorsed in 1986 and the applicant is entitled to three year <br />protection to develop the lot for uses permitted at the time. The <br />lot was also subject to the moratorium on building in certain areas for <br />purposes of examining potential water supply sites and the owner could <br />not obtain a building permit between September 1986 and August 1988. <br />Plans of the building were presented to the Board which have <br />been approved by the Design Review Committee. The building and <br />parking area would result in a lot coverage of approximately 39%. <br />Mr. Kirrane reviewed the design of the catch basins in the parking <br />area and stated that they are designed to catch the rain run-off_whi:cli_ <br />would be returned to the lot. He presented the Board with a letter <br />from I.E.P. Inc, environmental engineers, which explained that the <br />groundwater in the area is flowing in a southeasterly direction away <br />from the Groundwater Protection District. He questioned the need for a <br />Variance. <br />Mr. Friel questioned what type of retail tenants were proposed <br />and asked if any waste producing use was proposed. Mr. Makunas asked <br />for comments on the use of the building. <br />Mr. Ferragamo explained that the office will be located on the <br />• second floor and that there may be a need for retail space on the first <br />floor. He said future use of the space would be subject to the zoning <br />by-laws but he had wanted to plan building and parking to allow for <br />some flexibility. <br />
