U <br />MASHPEE BOARD OF APPEALS <br />Minutes <br />August 23, 1989 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />August 23, 1989 at 7:30 P.M. at the Mashpee Town Hall. Board members <br />present acting throughout were: Cheryl A. Hawver, William J. Hanrahan, <br />Michael A. Makunas, Richard E. Halpern and John J. Friel. Douglas <br />S. Boyd, Building Inspector, was in attendance. <br />Shirley Silver - Requests a Special Permit under Section 6.3.1.9 <br />of the Land Use Regulations for permission to construct a walkway, <br />dock, ramp and float in an R-3 zoning district on property located <br />at 43 S. Waterline Drive (Map 120, Block 148; Map 120, Block 147) <br />Mashpee, MA. <br />Shirley Silver - Requests a Variance under Section 6.3.I.9 <br />of the Land Use Regulations for permission to exceed a dock length <br />of 70 feet in an R-3 zoning district on property located at <br />43 S. Waterline Drive (Map 120, Block 148; Map 120, Block 147) <br />Mashpee, MA. <br />. Members sitting: Cheryl Hawver, Michael Makunas and William <br />Hanrahan <br />Attorney Richard Dubin and John Slavinsky, Cape and Islands <br />Surveying, represented the applicant. <br />• Mr. Hanrahan notified the Board that Attorney Dubin is a customer <br />of his employer and asked if there were any objections to his hearing <br />the petition. He stated he would sit on this petition since Mr. <br />Dubin was representing a client but would not sit on the next hearing <br />since Mr. Dubin is co-owner of the property. <br />Mr. Dubin presented the Board with a letter from New Seabury <br />authorizing Shirley Silver to cross the reserve land owned by New <br />Seabury for the use of the proposed walkway, ramp and float. <br />He reviewed plans and explained that the dock would be 122' from <br />mean high water. When the Silvers purchased the land the 70' <br />zoning rule was not in effect and they assumed they had waterfront <br />property. Mr. Dubin expressed the opinion that the dock would <br />minimize the impact on the wetlands and would cause less damage <br />than if people walked on the marsh. <br />Mr. Makunas asked if there was a path to the water at present <br />and Mr. Dubin responded that there was not. <br />Ruth Zuckerman, a resident <br />of the area, stated <br />that she was <br />• <br />in favor with <br />staying with the <br />standard of 70'. She <br />described <br />the area as a <br />unique marsh and <br />scenic area and would <br />prefer to <br />have it left <br />in a natural state. <br />She presented the <br />Board with <br />photos of the <br />area. <br />• <br />
