• <br />Board of Appeals Minutes - October 25, 1989 <br />Page .2. <br />Marjory Gordon _ Requests a Special Permit under Section 5.1 <br />of the Zoning By-laws for permission to expand a non -conforming <br />structure with the removal of a storage building and the addition <br />of a deck and closet in an R-3 zoning district on property located <br />at 31 Nick Trail (Map 117, Block 271) Mashpee, MA. <br />Members sitting: Cheryl Hawver, William Hanrahan, Michael Makunas <br />Presented by Contractor John Gavin. <br />Presently there is a metal building and a retaining wall. The <br />area of the deck is proposed. The metal building is 10' square <br />in width approx. 7' tall. He is proposing to put a concrete <br />retainiig wall on the end of the garage along the property line, <br />and put the enclosure for outside storage of trach cans etc. <br />The setbacks are the same. <br />Mr. Makunas.questioned the date on the plot plans which was <br />not legilble. He stated that they need to come up with the original <br />drawing to show that the shed existed. <br />There were no comments from abutters. <br />Mr. Makunas made a motion to accept the withdrawal without <br />prejudice. Mr. Hanrahan seconded. All agreed. <br />Albert J. Orlando - Requests a Variance fronSection 7.4 of the <br />Land space Requirements for permission to build a garage in an R-5 <br />zoning district on property located at 240 Wheeler Road (Map 49, Block <br />28) Mashpee, MA. '\• <br />Members sitting: Cheryl Hawver, William Hanrahan, Michael <br />Makunas. <br />Presented by Mr. Orlando. This area is in Briarwood which <br />was subdivided a while back. Most of the lots are a 75 foot frontage. <br />His is along the lot line. At the time the houses were built there <br />was a 15' side lot line. He needs to put in a garage. He has <br />permission from the Board of Health to build a garage as long as he <br />does not build on top of the system. He needs a side line set back <br />of 5.18.Pictures were presented. <br />There were no comments from abutters. <br />Mr. Hanrahanmade a motion that the variance be granted as requested <br />on the basis that there is a topographical hardship, the rear <br />slope and also location of the septic system. , <br />Mr. Makunas seconded. <br />All agreed. <br />
