MASHPEE BOARD OF APPEALS <br />Minutes <br />October 25, 1989 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />October 25, 1989 at 7:30 p.m. at the Mashpee Town Hall. Board members <br />present and acting throughout were Cheryl Hawver, William Hanrahan, <br />Michael Makunas, Richard Helpern and John Friel. Douglas Boyd, Building <br />Inspector, was in attendance. <br />Suzanne Nash - (Owner of record: Susan Dringer Nash) - Requests <br />a Variance from Section 7.7 of the Land Space Requirements for <br />permission to build a house addition and new deck within 50 feet of <br />Santuit Pond in an R-5 zoning district on property located at <br />57 Timberland Drive (Map 29, Block 33C) Mashpee, MA. <br />Members sitting: Cheryl Hawver, William Hanrahan, Michael Makunas <br />Mr. George Thorng of Arrow Engineering presented the plans. <br />Mr. Thorng stated that the applicant is proposing to build a house <br />addition and deck within 50 feet of Santuit Pond. Mr. Hanrahan <br />questioned the lot coverage percentages on the present house and <br />• the proposed additions. Mr. Thorng replied that the present lot <br />coverage including all of the walks and decks is 8.6%. The lot <br />coverage with the proposed additions will be 16.97,. <br />Mr. Thorng reviewed the septic system plans with the Board and <br />stated that the grade of the lot prevented expansion in other <br />areas. The Board was informed that the lot lines in the area had <br />been incorrectly recorded with the result that a corner of the house <br />is only 4' from the lot line. Mr. Boyd stated that the applicant <br />would also require a Special Permit. <br />Ms. Hawver read a memo from the Conservation Area concerning <br />the septic system. The memo stated that the plans do not show Title <br />V Compliance and that the current conditions of Santuit Pond indicate <br />an over abundance of nutrients. <br />Ms. Hawver also read comments from Elias McQuaid, Health Agent, who <br />stated the the type of septic system planned uses a sewer ejector <br />pump and this has to be approved by Mass. D.E.P. <br />The Board determined that the Title V concerns are not within <br />the authority of the Board of Appeals and would be under the <br />jurisdiction of the Board of Health. <br />Mr. <br />Makunas moved to grant <br />the <br />variance to build within 50' of the <br />• <br />water. <br />Mr. Hanrahan seconded. <br />All <br />agreed. <br />
