• <br />• <br />E <br />Board of Appeals November 8, 1989 Page 5. <br />Mr. Hanrahan reconsidered the motion. <br />Mr. Hanrahan noted for the record that the Modification of the Special <br />Permit modified January 29, 1985 was subsequently modified on <br />January 28, 1988, March 11, 1988, September 21, 1988 and October 14, 1988. <br />Mr. Hanrahan amended his motion to include: "Certificates of occupancy <br />issued prior to the completion of the amenities will require a Notice <br />of Release to the Town of Mashpee signed by the prospective purchaser <br />and form approved by Town Counsel." <br />Mr. Dunning asked if it would be wise to add the phrase "or no <br />further occupancy permits would be issued" if the amenity center were <br />not completed by March 30, 1990. Mr. Hanrahan replied that this was <br />self-evident. <br />Mr. Makunas seconded the reconsideration and the amendment. All agreed. <br />Ms. Hawver called a 10 minute recess at 8:40. Ms. Hawver called the <br />meeting to order at 9:00 p.m. <br />Alexander M. Levine - Requests a Special Permit under Section 6.3.I.9 <br />of the Land Use Regulations for permission to add a ramp and float to <br />an existing dock in an R-3 zoning district on property located at <br />1 N. Waterline Drive (Map 120, Block 172) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, E. Govoni <br />Mr. George Thorng of Arrow Engineering represented the applicant. He <br />explained that the owner wished to legalize a ramp and float built six <br />years ago. He explained that a Special Permit was required from the <br />Board of Appeals before applications could be filed with the Conservation <br />Commission. Ms. Hawver read a memo from the Conservation Commission <br />which stated that the dock was in violation of the Mass. Wetlands Act. <br />The Commission expressed concern since the site is in the A.C.E.C. <br />Paul Somerville, Shellfish Constable, read comments on the marine life <br />at the site and stated that the applicant should be able to defend the <br />position that the structure will not do damage to the marine or coastal <br />environment. <br />Mr. Govoni asked if any damage had been done in the six years of use and <br />Mr. Somerville replied that there were some bald spots. No comments were <br />received from abutters. <br />Mr. Govoni informed Mr. Thorng that the plans presented were lacking in <br />complete dimensions and asked that the Board be supplied with new plans. <br />Mr. Govoni moved to take the petition . under advisement. Mr. Makunas <br />seconded. All agreed. <br />
