MASHPEE BOARD OF APPEALS
Minutes
January 10, 1990
i
The Mashpee Board of Appeals held a meeting on Wednesday,
January 10, 1990 at 7:30 p.m. at the Mashpee Town Hall. Board
members present and acting throughout William Hanrahan, Michael
Makunas, Cheryl Hawver, Richard Halpern, Edward Govoni and John
Friel. Douglas Boyd, building inspector, was in attendance.
Forward Development Corporation - Requests a Variance under
Section 174-46.E.6.0 of the Zoning By-laws for permission to vary
the sidewalk requirements in the Quashnet woods Open Space
Incentive Development on property located in an R-3 zoning district
at 765 Falmouth Road (Map 81, block, 1) Mashpee, Ma.
Members sitting: William Hanrahan, Michael Makunas, Cheryl
Hawver
Attorney Alexander L. Dittami represented Forward Development.
Mr. Dittami stated that as indicated they were here to. request_ a
variance from section 9.3.5.6.0 of the Town of Mashpee Zoning By-
laws. This particular section would normally require sidewalks
to be installed on the side of any road which they would-be putting,
in this subdivision. They are requiring it because they are going
to be generating over 500 trips a day on this roadway.. The road-
way which has been laid out was approved under the OSID permit
issued and modified by the Town of Mashpee Planning Board. In
this particular configuration they have not put sidewalks around
the edoe of the roadway. They will be including an additional
sidewalk from Route 28 up along the side of the entrance road and
on the side of the roadway extending up to cluster 1, cluster 3,
and crosses over to #5.
This design and variance will only affect this particular
parcel. It is consistent with the intent of the By-law, that is
the pedestrians walkways beside the street, is the intent as he
understands it to promote pedestrian safety and convenience. By
making the walkways more convenient for those who_ would be using
it the most, people going from building to building and by removing,.
from the hazards of the roadway will in fact enhance the purpose
of the By-law.
Mr. Dittami also indicated that this particular.walkway-ex-
tended from Route 28 provides the most direct road from Route 28
to the Whitings Road area.
