i <br />MASHPEE BOARD OF APPEALS <br />r <br />i <br />Minutes <br />• January 24, 1990 <br />I <br />The Mashpee Board of Appeals held a meeting at 7:30 p.m. on <br />Wednesday, January 24, 1990 at the Mashpee Town Hall. Board members <br />present and acting throughout were: Cheryl' A. Hawver, Michael A. Makunas, <br />Richard E. Halpern, Edward M. Govoni and John J. Friel. <br />Florence A. Wall - (Owner of record: Geoffrey T. Wall) - Requests a <br />Special Permit under Section 174-17 of the Zoning By-laws for permission <br />to change and expand a non -conforming structure in an R-5 zoning district <br />on property located at 146 Ninigret Ave, (Map 65, Block 79) Mashpee, MA. <br />Florence A. Wall - (Owner of record: Geoffrey T. Wall) - Requests <br />a Variance under Sections 174-28A and 174-31 of the Land Space Requirements <br />for permission to vary the setbacks in an R-5 zoning district on property <br />located at 146 Ninigret Ave. (Map 65, Block 79) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, R. Halpern <br />Mr. Charles Spohr represented the Applicant. He explained that the <br />Conservation Commission had no objections to the plans. He informed the <br />Board that the Applicant was requesting permission to build a new sundeck, <br />living room addition and a small deck. They will be removing 204 sf of <br />10 existing deck space. The additions will result in an increase of 236sf. <br />Mr. Makunas and Mr. Halpern questioned an earlier petition on this <br />property and requested the 1988 files. They reviewed the earlier plan <br />and said that a tool shed on the property was to have been removed. <br />This Decision granted a Variance of 16' from Ninigret and a 4' Variance <br />from Canonchet Ave. Mr. Halpern explained that only one Variance was <br />now needed on the setback from Sakonnet Drive. <br />Mr. Makunas questioned if the front stairs had been included in the <br />lot coverage figures or setback measurements. Mr. Spohr replied that <br />part of the plan had been done by an architect and he was not certain <br />if stair measurements had been included. Mr. Friel questioned the lot <br />coverage and Mr. Spohr estimated it at 16.53%. <br />Mr. Makunas asked that replies to the following questions be submitted <br />to the Board: <br />1. are the stairs included in the lot coverage figures? <br />2. do the setback figures include the stairs? <br />3. has the tool shed been removed? <br />Mr. Makunas moved to take the applications under advisement pending <br />receipt of revised plans and satisfactory answers to the above questions. <br />Mr. Halpern seconded. All agreed. Mr. Makunas suggested that new <br />drawings reflect accurate lot coverage and be signed as a revised plan <br />to be included with the Decision. <br />
