Mashpee Board of Appeals Minutes - January X24, 1990 Page 5. <br />• Charles J. Viglas - (Owner of record: Charles J. and Jean D. Viglas) <br />Request a Special Permit under Section 174-25.1.9 of the Zoning By-laws <br />for an existing unlicensed pier, ramp and floats in an R-3 zoning district <br />on property located at 71 Frog Pond Close (Map 90, Block 51) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, J. Friel <br />Jeffrey Ryther of Holmes and McGrath Engineering represented the <br />Applicant. He explained that the Application was for the licensing of <br />an existing landing, fixed pier and floats. He reviewed the locus and <br />said that the water was shallow in the area and they were looking for a <br />2' depth at the end of the 8' x 12' float. Mr. Viglas said that the <br />structures had existed for over two years. <br />Mr. Ryther said the channel is 400' wide so that the structure does <br />not affect navigation and that the height over the marsh is 4'1". <br />Paul Somerville, Shellfish Constable, questioned if the Applicant <br />needed a Variance due to the length of 150'. <br />Mr. Makunas commented that the Assessor's records indicated that a <br />dock was on the property in 1986. Mr. Viglas responded that his family <br />had extended the original dock. <br />Mr. Somerville questioned if the project had an Order of Conditions <br />• from Conservation and Mr. Ryther replied that they were in the process <br />of applying to Conservation. <br />Mr. Somerville said that there was a soft shell clam resource area <br />within 20' and he would prefer to see a permanent.structure to rise above <br />it. He said the area has never been considered a significant quohog <br />resource area. He recommended that the inside edge of the first float <br />be at least 20' off of the edge of the saltmarsh. <br />Mr. Viglas commented that he had thought it would be less impact <br />on the environment to keep boats from churning up the silt nearer to <br />the shore. <br />Robert Sherman, Conservation Agent, said his Commission had <br />concerns about the deterioration of the bank and these would be <br />addressed in Conservation. <br />Mr. Friel moved to grant a Special Permit for a 70' dock with plans <br />to reflect the recommendations of the Shellfish Constable. Mr. Makunas <br />seconded. All agreed. <br />1] <br />
