Mashpee Board of Appeals Minutes - January
i
i
24,
1990 Page 6.
• Sidney Covich - (Owner of record: Leonard Jolles and Jane Lonergan TRS)
Request a Special Permit under Section 174.25.I.9 of the Zoning By-laws
for an existing unlicensed pier, ramp and floats in an R-3 zoning district
on property located at 141 Daniel's Island Road (Map 105, Block 277)
Mashpee, MA. N.
Members sitting: C. Hawver, M. Makunas, J. Friel
Jeffrey Ryther of Holmes and McGrath Engineers represented the
Applicant. He presented plans for an existing pier, ramp and floats.
Ms. Hawver informed the Board that the Assessor's records indicated
that the house had been built in 1975 and the dock in 1981.
•
•
Paul Somerville, Shellfish Constable, said that this application
has been through Conservation and has an Order of Conditions. He
understood that the property had had a pier and a float and that
additional floats had been added without permits. He said that if
the application is being handled as a new structure he would like to
see the pier longer. He informed the Board that there was a soft shell
clam resource and quohog habitat in the area. He would like the pier
elongated but would not look favorably on a Variance request.
Mr. Somerville mentioned that Chester Koblinsky, Harbor Master,
would have records on the float permits for the property.
Mr. Ryther reviewed the plans and said that a 70' length
limitation would mean eliminating a float. There was discussion of
ice damage to the 4' x 4' construction.
Mr. Somerville stated that the shorter design might not
accomodate Mr. Covich's boats. Mr. Govoni asked what problem there
would be in granting a length Variance. Mr. Somerville replied that
the area was a good quohog habitat and fishermen worked from boats
there. He suggested that all motorized boats be restricted to the
outside of the float.
Mr. Ryther said that the ownei would expect to have floats for
his two or three boats.
Mr. Friel moved to grant a Special Permit for a 70' dock with a
30'6" float with the changes to be made in the ramp structure as noted
by the Shellfish Constable and the Shellfish Constable to sign off on
the plan. Mr. Makunas seconded. All agreed.
