• <br />BOARD OF APPEALS Minutes - February 28, 1990 5. <br />ADVISEMENT <br />Florence Wall (From January 24, 1990 meeting) <br />Members sitting: C. Hawver, M. Makunas, R. Halpern <br />Mr. Makunas moved to deny the application for a Special Permit <br />and a Variance due to excessive lot coverage and absence of a hardship. <br />Ms. Hawver seconded. All agreed. <br />(Note: The taped record of the vote was inconclusive on whether <br />the denial was made with or without prejudice. A poll of the members <br />indicated their intention to deny without prejudice.) <br />John Finn (From February 14, 1990) <br />Members sitting: M. Makunas, W. Hanrahan, E. Govoni <br />Mr. Finn discussed the lot coverage and plans for the deck but <br />did not submit a new plan as requested. <br />Mr. Makunas moved to continue the application under advisement <br />• pending receipt of a modified plan. Mr. Hanrahan seconded. All agreed. <br />Fred and Suzanne M. Luconi <br />Mr. Luconi asked if the Board would consider a request to reconsider <br />the earlier vote. He asked for a continuance to present a modified <br />plan. The Board did not agree to a continuance. <br />Anthony Pelusi - (From February 14, 1990) <br />Members sitting: C. Hawver, E. Govoni, J. Friel <br />Engineer Larry Hall presented new plans. Mr. Boyd stated that <br />the lot is less than 5,000 sf and questioned if the existing deck is <br />illegal. Ms. Hawver suggested that an opinion be obtained from Town <br />Counsel on the interpretation of the by-laws. The Board determined <br />that a Building Permit could not be issued even if the Permit was <br />granted. It was suggested the applicant withdraw. Mr. Hall requested <br />to withdraw without prejudice. <br />Mr. Govoni moved to accept the withdrawal without prejudice. <br />Mr. Friel seconded. All agreed. <br />Michael Moscowitz - (From January 24, 1990 meeting) <br />• Members sitting: C. Hawver, M. Makunas, E. Govoni <br />Mr. Makunas moved to grant the Special Permit per revised Cape <br />& Islands Plans dated January 26, 1990. Mr. Govoni seconded. All agreed. <br />Mr. Makunas moved to adjourn.
