MASHPEE BOARD OF APPEALS <br />MINUTES - February 28, 1990 <br />6 ADDENDUM <br />Discussion <br />Board members discussed three zoning articles to be submitted for <br />the Special Town Meeting Warrant. Mr. Makunas moved to submit two <br />of the articles and Mr. Govoni seconded. All agreed. The wording <br />of the articles to be submitted is: <br />1. To see if the Town will vote to amend Section 174-33 of the <br />Zoning By-laws by adding the following sentence: <br />"Any fixed or floating piers, wharves, docks, boardwalks, <br />both seasonal and year-round, may be grantec�a variance from <br />the Board of Appeals to exceed the seventy (70) foot <br />requirement as defined in 174-25.I.9." <br />2. Nonconforming Structures Ten (10) years or older <br />In Accordance with Section 7 Chapter 40A M.G.L. a structure <br />which has not been in compliance with this by-law or any law <br />under Chapter 40A or with the conditions set forth in any Special <br />Permit or Variance affecting the structure for a period of ten <br />(10) years or more from the commencement of the violation, may <br />not be the subject of any enforcement action by the Town to <br />compel the removal, alteration or relocation of such structure. <br />Structures which qualify under Section 7 Chapter 40A M.G.L. are <br />considered to be nonconforming structures and are entitle to <br />treatments as such as provided in this Section" <br />or take any other action thereon. <br />Elinor Walsh <br />6. <br />
